Spring 2009 ECF Upgrade

Alert: CM/ECF in Wisconsin Western Bankruptcy was upgraded from version 3.2 to version 3.3.1 March 14th 2009.

The majority of the changes were behind the scenes. Please see the summary of New Features for a list and explanation of the changes.

National Guard and Reservists Debt Relief Act of 2008

ALERT! Effective December 19, 2008
On October 20, 2008, the President signed the National Guard and Reservists Debt Relief Act of 2008, Pub. L. No. 110-438. The Act provides a temporary exclusion from the bankruptcy means test for Reservists and members of the National Guard called for no less than 90 days to active duty or homeland defense activity following September 11, 2001. The amendment to section 707(b)(2)(D) of the Bankruptcy Code will be effective on December 19, 2008, which is 60 days after enactment. The amendment applies only to cases commenced in the three-year period beginning on the effective date of the Act.

Notice: General Order No. 1-08
Effective December 1, 2008, the Court vacates the orders of October 13, 2005 and September 2006, which adopted the Interim Bankruptcy Rules, with the exception of Rule 5012, which remains in effect until further order of the Court. The new and amended Federal Rules of Bankruptcy Procedure are effective December 1, 2008.

The following four related cases filed for bankruptcy in Western Wisconsin, pursuant to chapter 11 on September 15, 2008:

  • Monarch Holdings, Inc. 1-08-14796-11 (all filing in this lead case)
  • Hurd Windows and Doors, Inc. 1-08-14794-11 (jointly administered in lead case)
  • Monarch Manufacturing Company 1-08-14797-11 (jointly administered in lead case)
  • American Weather-Seal Company 1-08-14799-11 (jointly administered in lead case)
