TWO MEN INDICTED ON FEDERAL IMMIGRATION CHARGES

Two aliens were indicted separately by a Federal Grand Jury today for violation federal immigration laws, announced U. S. Attorney Jim Letten.

In the first case, MIGUEL OSWALDO CANO-SOTO age 27, a resident of Mexico, was charged in a one-count indictment for illegal re-entry by an alien previously deported. According to the indictment, on December 19, 2008, MIGUEL OSWALDO CANO-SOTO, who had previously been removed and deported, was found in the United States without having obtained consent from the Secretary of the Department of Homeland Security to reapply for admission to the United States.

If convicted, CANO-SOTO faces a maximum term of imprisonment of two (2) years, a fine of $250,000.00 and one year of supervised release following any term of imprisonment.

In the second case, HECTOR ANTONIO MALDONADO-ESCALANTE age 41, a resident of El Salvador, was charged in a one-count indictment for illegal re-entry by an alien previously deported. According to the indictment, on January 19, 2009, HECTOR ANTONIO MALDONADO-ESCALANTE, who had also been previously deported, was found in the United States without having obtained consent from the Secretary of the Department of Homeland Security to reapply for admission to the United States. It is also alleged that MALDONADO-ESCLANTE was convicted of an aggravated felony prior to his previous removal.

If convicted, HECTOR ANTONIO MALDONADO-ESCALANTE faces a maximum term of imprisonment of twenty (20) years, a fine of $250,000 and three years of supervised release following any term of imprisonment

U. S. Attorney Letten reiterated that an indictments is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

These investigations were conducted by Immigration and Customs Enforcement. The cases are being prosecuted by Special Assistant U. S. Attorney Robert Weir.
