CITIZEN OF HONDURAS SENTENCED TO 30 MONTHS IN PRISON FOR ILLEGALLY REENTERING THE U.S.

Nora R. Dannehy, Acting United States Attorney for the District of Connecticut, announced that ELMER ALBERT NAVARRO-LOBO, 32, a citizen of Honduras, was sentenced today Senior United States District Judge Peter C. Dorsey in New Haven to 30 months of imprisonment for illegally reentering the United States after being deported.  NAVARRO-LOBO pleaded guilty to the offense on January 6, 2009.

According to documents filed with the Court and statements made in court, NAVARRO-LOBO illegally reentered the United States after being deported to Honduras on December 18, 2003.  The deportation followed a felony criminal conviction in 1999 in Florida for battery against a person older than 65.  NAVARRO-LOBO’s criminal history also includes felony convictions in 2000 in Florida for battery of a police officer and disorderly intoxication, and in 2002 in Waterbury Superior Court for third degree burglary, conspiracy to commit third degree burglary, and fourth degree larceny.

On July 17, 2008, NAVARRO-LOBO was arrested in Waterbury.

Before reentering the United States, anyone who has been deported must have the express consent of the U.S. Attorney General or his successor, the Secretary of the Department of Homeland Security.  NAVARRO-LOBO did not seek such consent.

This case was investigated by Deportation Officers of U.S. Immigration and Customs Enforcement, Detention and Removal Operations, with the assistance of the Waterbury Police Department.  The case was prosecuted by Assistant United States Attorney David T. Huang.
