V. Primary Delegations of Authority

The Secretary has delegated the following authorities to the Assistant Deputy Secretary for Safe and Drug-Free Schools subject to certain reservations:

Under the Elementary and Secondary Education Act of 1965, as amended (ESEA),and the Higher Education Act of 1965:

Title II, Part C, Subpart 3, of the ESEACivic Education Sections 2344 and 2345
Title IV, Part A, Subpart 1 of the ESEA Safe and Drug-Free Schools and Communities State Programs
Title IV, Part A, Subpart 2 of the ESEA Safe and Drug-Free Schools and Communities National Programs
Title IV, Part A, Subpart 2 of the ESEA School Emergency Response to Violence (SERV)
Title IV, Part C of the ESEA Environmental Tobacco Smoke (Pro-Children Act)
Title V, Part D, Subpart 2 of the ESEA Elementary and Secondary School Counseling Programs
Title V, Part D, Subpart 3 of the ESEA Character Education
Title V, Part D, Subpart 10 of the ESEA Physical Education
Title X, Sec. 9532 of the ESEA Unsafe School Choice
Section 601 of the Nationa Literacy Act Literacy Programs for Prisoners
Title VIII, Section D of the HEA State Grants for Incarcerated Youth Offenders

The Secretary has also delegated to Principal Officers certain administrative authorities subject to certain reservations.
