Investment Opportunity for Construction and Operation of Airports

Note:

The following tender is currently on hold at the Ministry of Culture, Tourism and Civil Aviation (MOCTCA). The Government of Nepal, MOCTCA has plans to float fresh tender for the four airport projects in the near future, with minor modifications in the project proposal.

Purchase of Tender Documents and Submission of EOI: November 5, 2004

SCOPE OF WORK:

1. Under the "Infrastructure Development and Operation by Private Investment Ordinance 2004", and rules under it His Majesty's Government of Nepal (HMG/N) Ministry of Culture, Tourism and Civil Aviation (MOCTCA) intends to obtain a Letter of Interest or Expression of Interest from a competent and experience firm or company for:

- Development, extension and operation of Gautam Buddha Regional International Airport, Bhairawa,

- Construction and operation of Pokhara Regional International Airport, Pokhara at Chhinnedanda, Pokhara,

- Development, extension, and operation of existing Dhangadhi Airport, Dhangadhi in Far Western Nepal as hub Airport, and

- Construction and operation of Dharan Short Take Off Landing (STOL) airport at Dharan, Sunsari district in Eastern Nepal.

All the above projects would be done under Build-Own-Operate And Transfer (BOOT) concept.

2. Any individual, partnership firm, or corporation, whether local or foreign, including joint venture or consortia of local and foreign firms, subject to the limits herein set, may participate to apply for short listing procedures established in accordance with existing laws of Nepal for the purpose of accomplishing the projects covered under the provisions of the Ordinance and Rules.

3. A complete set of Terms of Reference (TOR) may be purchased by interested eligible applicants on submission of a written application to the Ministry of Culture, Tourism and Civil Aviation Build-Own-Operate and Transfer (BOOT) Schemes, Singha Durbar, Kathmandu, until November 5, 2004. Applicants will have to deposit an amount of US $ 205 for a complete set of TOR documents for Pokhara International Airport, Pokhara, and US $ 136 each for a complete set of TOR documents for Gautam Buddha Airport, Dharan Airport, and Dhangadhi Airport. These deposits are nonrefundable and will have to be made in the account No. Ka 1-1 -05-99 of Nepal Rastra Bank.

4. All EOIs must be delivered to Ministry of Culture, Tourism and Civil Aviation, Build-Own-Operate and Transfer (BOOT) Schemes, Singha Durbar, Kathmandu on or before November 5, 2004 within the office hours. Application will be opened at 14:00 Hours on November 6, 2004 in the MOCTCA office. Applications shall be opened publicly and normally in the presence of all the applicants or their representatives. However, opening of the applications would not be stopped even if the proponents or their representatives choose to remain absent.

5. In case the last purchase or submission or opening day happens to be a government holiday the next working day shall be considered as the last date for the purchase, submission or opening of the applications (EOI).

6. An EOI for an airport should be sealed in an envelope specifically marked with the airport’s name:

"Expression of Interest for the Construction and operation of Gautam Buddha Airport, Bhairahawa as a Regional International Airport under Build-Own-Operate and Transfer (BOOT) concept for Bhairawa”,

"Expression of Interest for the Construction and operation of New Pokhara Airport, Pokhara as a Regional International Airport under Build-Own-Operate and Transfer (BOOT) concept for Pokhara”,

“Expression of Interest for Construction and Operation of Dharan Short Take Off and Landing (STOL) Airport, Dharan, Sunsari under Build-Own-Operate and Transfer (BOOT) concept for Dharan”,

“Expression of Interest for Development Extension and operation of Existing Dhangadhi Airport, Dhangadhi as a Hub Airport” under Build-Own-Operate and Transfer (BOOT) concept for Dhangadhi.

7. All applicants must purchase the TOR from MOCTCA. In addition, an EOI must be received by the due date and time to be considered for evaluation.

9. Applications that do not meet the entire minimum qualifying criteria may not be considered for the short listing.

10. A site visit is mandatory for Pokhara and Dhangadhi. Applicants must submit with the EOI official evidence of a site visit from Pokhara Airport Civil Aviation Authority office and Dhangadhi Airport Civil Aviation authority office.

11. Applicants should propose the tentative site(s) for construction of STOL airport in Dharan.

12. The MOCTCA shall not be responsible for any of the cost or expenses incurred by the Firm in connection with the preparation of an EOI.

13. MOCTCA reserves the rights to accept or reject any or all EOIs with or without giving any reason whatsoever.

14. International firms must follow the existing "Foreign Investment and Technology Transfer Act " of Nepal.

15. Application should be delivered directly in the MOCTCA office. Application will not be accepted by mail or fax or other sources.
