BEFORE THE FEDERAL COMMUNICATIONS COMMISSION In re The Wild Outdoors, Jay Gregory and Tammy Gregory Petitioners, PETITION FOR FULL EXEMPTION FROM CLOSED CAPTIONING REQUIREMENTS COMES NOW, The Wild Outdoors and its video programming producers and video programming owners, Jay Gregory and Tammy Gregory, and for their Petition for Full Exemption From Closed Captioning Requirement and state as follows: 1. That Petitioners are the owners and producers of The Wild Outdoors, a hunting and fishing television based in Breckenridge, Missouri. 2. That The Wild Outdoors production company and owner consists of Jay Gregory and his wife Tammy Gregory and there are no other employees or independent contractors associated with the production company. 3. That The Wild Outdoors is broadcast weekly on television stations in Kansas City, Missouri, St. Joseph, Missouri, and The Outdoor Channel. 4. That 26 shows are produced each year, and each show is thirty minutes in duration. 5. That for Petitioners to provide for closed captioning would constitute an undue burden upon The Wild Outdoors, Jay Gregory and Tammy Gregory in the following respects: a. That Petitioners do not have the technical capabilities to provide for closed captioning; b. That to obtain the closed captioning service will cost approximately $480.00 per show or $12,480.00 per year. The cost quoted is for "pop up" captions; c. That Petitioners would be unable to produce and market The Wild Outdoors if they were required to provide for closed captioning; d. That Petitioners do not possess the financial means to absorb the cost of closed captioning and if this exemption is not granted, the Petitioners would cease production of The Wild Outdoors, because of cost and budget restraints. e. That the financial resources of Jay Gregory and Tammy Gregory are limited to the extent that they could not continue to produce The Wild Outdoors, if closed captioning is required. f. That the 26 new shows produced yearly for the Outdoor Channel have to be re-edited in regards to introduction, narration and commercials in order to be broadcast on the Kansas City and St. Joseph television station, therefore greatly increasing the amount and cost of closed captioning.
