CHEVRON NRDAR SETTLEMENT REACHED

Corpus Christi Ecological Service Field Station NRDAR Trustees in cooperation with NOAA and Texas State Trustees reached settlement with Chevron U.S.A. that provides for restoration projects as compensation for natural resource damages resulting from the release of hazardous substances and the discharge of oil from the Port Arthur Refinery in Jefferson County, Texas.

Under the agreement, Chevron will be responsible for undertaking a variety of restoration actions to compensate for natural resource losses. Chevron will construct and plant at least 85 acres of estuarine marsh and approximately 30 acres of wet prairie and will construct water control structures to enhance nearly 1,600 acres of coastal wet prairie near Port Arthur, Texas. Chevron will also pay costs incurred by the Trustees in evaluating the natural resource damages resulting from the contamination at the refinery and in determining appropriate restoration actions. The Restoration Plan has been completed and Chevron will implement project construction by mid 2005 under the oversight of the State and Federal Trustees.
