The above-captioned applications, filed by common carriers or their affiliates, all request authority from the Commission under Section 214 of the Communications Act of 1934 to acquire, construct, or operate facilities for the provision of video programming services. Pursuant to Section 302(a) of the Telecommunications Act of 1996 (which added new Section 651(c) to the Cable Communications Policy Act of 1984), these applicants are no longer required "to obtain a certificate under Section 214 with respect to the establishment or operation of a system for the delivery of video programming." We find that the above-captioned applicants meet the requirements of Section 302(a) and, as a result, are not required to obtain Section 214 authority for their proposals.
