SECTION
LINE LAWS
January
5, 2009
In
an opinion addressing public travel on section lines, Attorney
General Stenehjem concluded that section lines, to be open
to public use, do not have to be improved or conducive to
travel, and that if for some reason the full sixty-six foot
right-of-way is unavailable for public travel, whatever narrowed
right-of-way remains is subject to public use.
