Fugitive indicted for failure to report for sentence

MIAMI - A U.S. Immigration and Customs Enforcement (ICE) fugitive and former Miami resident was returned to South Florida to face charges for failing to surrender for service of his prison sentence in an alien smuggling case.

Angel Cespedes-Osorio, 35, was indicted in January for failing to surrender to serve a sentence after his conviction for conspiracy to smuggle aliens into the United States.

In June 2007, U.S. Coast Guard interdicted Cespedes-Osorio's boat approximately 30 miles south of Key West, Fla., while attempting to bring 34 Cuban nationals to the United States in violation of immigration law. He was sentenced to 30 months in prison on Dec. 22, 2008, after pleading guilty to conspiracy to smuggle aliens into the United States. Cespedes-Osorio was ordered by the court to report to prison for service of sentence on Jan. 14, 2009.

On Jan. 15, 2009, Cespedes-Osorio was apprehended by Canadian authorities while attempting to illegally enter Canada from the United States. ICE agents identified Cespedes-Osorio as an ICE fugitive. Cespedes-Osorio was turned over to the U.S. Marshals Service on Jan. 23, 2009, at the Canadian Border.

If convicted, Cespedes-Osorio faces up five years imprisonment to run consecutively with the 30 months imprisonment he received for conspiracy to smuggle aliens into the United States.

He made his initial appearance yesterday in court in Miami before Magistrate Judge Stephen T. Brown and was remanded without bond.

This case is being prosecuted by Assistant U.S. Attorney Russell Brown.
