U.S. charges 22 with narcotics, robbery and firearms offenses

NEW YORK, NY - Michael J. Garcia, the United States Attorney for the Southern District of New York, William G. McMahon, the special agent in charge of the New York Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Kevin Delli-Colli, acting special agent in charge of the New York Office of the Department of Homeland Security's U.S. Immigration and Customs Enforcement (ICE), and Raymond W. Kelly, the Commissioner of the New York City Police Department (NYPD) announced today the unsealing, in Manhattan federal court, of a four-count superseding indictment charging 22 individuals, operating in the vicinity of 213 Street and DeKalb Avenue, Bronx, New York, with various narcotics conspiracy, robbery conspiracy, attempted robbery and firearms offenses. As alleged in the indictment:

In early May 2003, Hibah Lee, Mark Gabriel, a/k/a "Bubbles," Bobby Moore, JR., a/k/a "Pops," Andre Davidson, a/k/a "O Dog," and Mark Hart, a/k/a "Movements," conspired to rob individuals whom they believed to be in possession of narcotics and narcotics proceeds. Mark Hart provided information to the others regarding the intended targets of the robbery, and on May 21, 2003, in the vicinity of 2041 Strang Avenue, Bronx, New York, these five defendants, four of whom were present and one who is charged with aiding and abetting, attempted to rob several individuals of large bags that the defendants believed contained narcotics and narcotics proceeds. During the course of the attempted robbery, Lee and Gabriel both shot at one of the individuals.

The indictment also names the following defendants as members of a narcotics conspiracy: Bobby Saunders, a/k/a/ "Bobby Moore," Carmen Moore, a/k/a "Munchie," Bobby Moore, Jr., a/k/a "Pops," Tyrone Moore, a/k/a "Puss," Hisan Lee, a/k/a "Devontea Clark," a/k/a "Ice," Hibah Lee, Andre Davidson, a/k/a "O Dog," Selbourne Waite, a/k/a "Silky," Delroy Lee, a/k/a "Specs," a/k/a "DJ," Robert Morrison, a/k/a "Chips," Mark Gabriel, a/k/a "Bubbles," Dakwan Edwards, a/k/a "Doc," Marquish Jones, a/k/a "Lunchbox," Mark Hart, a/k/a "Movements," Raheem Tucker, a/k/a "Ras," Walter Malone, a/k/a "Demetri Young," Christopher Diaz, a/k/a "X Box," Anthony Diaz, a/k/a "Little X," Paul Love, Aaron Birch, a/k/a "A," Kevin Beckford, a/k/a "Carl Beckford," and Jermell Falzone, a/k/a "Mel." The members of this drug organization and their associates conspired to sell narcotics in the vicinity of 213 Street and DeKalb Avenue, Bronx, New York. From 1999 until approximately April of 2007, the amount of crack cocaine sold by the organization exceeded 50 grams, the amount of powder cocaine exceeded five kilograms, and the amount of marijuana exceeded 1,000 kilograms. Narcotics were also sold to undercover officers and confidential informants. On several occasions, the narcotics possessed by the conspirators were the proceeds of robberies. On April 6, 2003 one of the narcotics conspiracy defendants, Dakwan Edwards, a/k/a "Doc," is alleged to have been in possession of a sawed-off shotgun, as well as quantities of both cocaine and marijuana.

If convicted, each of the 22 defendants faces a maximum sentence of life in prison without parole.

This case has been assigned to the Honorable Barbara S. Jones.

Mr. Garcia praised the outstanding efforts of the ATF, ICE, and NYPD in connection with this investigation.

Assistant United States Attorneys Elizabeth F. Maringer and Michael Q. English are in charge of the prosecution.

The charges contained in the indictment are accusations and the defendants are presumed innocent unless and until proven guilty.
