Orchard Park man arrested on child pornography charges
Man possessed images on his computer showing children having sex

ORCHARD PARK, N.Y. - Special agents from U.S. Immigration and Customs Enforcement (ICE) this morning arrested 33-year-old Daniel V. Nowakowski, of Orchard Park for possessing child pornography. According to the criminal complaint filed in U.S. District Court Nowakowski admitted to investigators that he had approximately 200 child pornography images on his computer.

He is charged with a violation of Title 18 USC Section 2252A (5) (B), knowingly possessing visual depictions of persons under the age of 18 engaged in sexually explicit conduct through interstate commerce. Investigators determined that some of the images were obtained from a website in Ontario, Canada. The criminal complaint describes two of the images seized during the investigation as prepubescent boys engaged in sexual conduct.

"Operation Predator is an ICE priority because those who purchase child pornography fuel the appalling international exploitation of innocent children," said Thomas A. DiSimone, assistant special agent in charge of ICE's Office of Investigations in Buffalo. "Possession of child pornography is not a victimless crime. Those who engage in this criminal behavior should be forewarned that ICE will use all of its resources to locate and arrest them."

DiSimone credited Terrance P. Flynn, U.S. Attorney for the Western District of New York, with aggressively prosecuting child pornography cases. Nowakowski had an initial appearance in federal court this afternoon and was released on bail with requirements to report to the U.S. Probation office. He will be confined at home with electronic monitoring.

The arrest of Nowakowski is part of Operation Predator; an ICE initiative to protect children from criminal alien sex offenders, child sex tourists, Internet child pornographers and human traffickers. The case against Norris grew out of an earlier investigation into a Belarus-based company that provided billing services for child pornography websites and operated child pornography sites of its own. Since Operation Predator was launched in July 2003, more than 9,800 arrests have been made, including more than 690 in New York.

U.S. Immigration and Customs Enforcement (ICE) was established in March 2003 as the largest investigative arm of the Department of Homeland Security. ICE is comprised of five integrated divisions that form a 21st century law enforcement agency with broad responsibilities for a number of key homeland security priorities.
