AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

NEBRASKA 21(d) CONSULTATION PROJECT

The Occupational Safety and Health Administration (OSHA), Nebraska Department of Labor - Workforce Development, USDOL Wage and Hour, 21(d) OSHA Consultation Program, the Nebraska Golf Course Superintendent Association (NGCSA), the Nebraska Professional Lawn Care Association (NPLCA), and the Sports Turf Managers Association (STMA) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA, Workforce Development, Wage and Hour and 21(d) OSHA Consultation, NGCSA, NPLCA, and STMA hereby form an Alliance to provide NGSCA, NPLCA and STMA members and others in the landscaping and lawn care industry, including youth and non English speaking workers, with information, guidance and access to training resources that will help them protect employees' health and safety, particularly in reducing exposure to landscaping and lawn care industry hazards. The Alliance will focus on noise, chemicals, machine guarding, ergonomics and weather related hazards and the use of personal protective equipment (PPE). In developing this Alliance, OSHA, Wage and Hour, NGCSA, NPLCA, STMA, and Nebraska Department of Labor recognize that OSHA's State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA, Nebraska Department of Labor, Wage & Hour, 21(d) OSHA Consultation, NGCSA, NPLCA and STMA will work together to achieve the following training and education goals:
  • Work with OSHA to provide the expertise to develop training and education programs on landscaping and lawn care industry hazards, such as noise, chemicals, machine guarding, ergonomics, weather related hazards and the use of PPE, for youth and non-English speaking workers.
OSHA, Workforce Development, Wage & Hour, 21(d) OSHA Consultation, NGCSA, NPLCA and STMA will work together to achieve the following outreach and communication goals:
  • Work with OSHA to develop and disseminate information through print and electronic media, including electronic assistance tools and links from OSHA's, Workforce Development, Wage & Hour, 21(d) OSHA Consultation, NGCSA, NPLCA and STMA Web sites.

  • Speak, exhibit, or appear at OSHA's or NGCSA, NPLCA, or STMA conferences, meetings or other events to promote the effectiveness of safety and health programs.

  • Share information among OSHA personnel and industry safety and health professionals regarding NGCSA, NPLCA, and STMA's best practices or effective approaches and publicize the results through outreach by NGCSA, NPLCA, and STMA and through OSHA, Wage and Hour, Nebraska Workforce Development, 21(d) Consultation Program or NGCSA, NPLCA, and STMA-developed materials, training programs, workshops, seminars, and lectures.

  • Work with other Alliance participants on specific issues and projects on hazards associated with the landscaping and lawn care industries, such as noise, chemicals, machine guarding, ergonomics, weather related hazards and the use of PPE, that are addressed and developed through this Alliance Program.

  • Encourage NGCSA, NPLCA, and STMA chapters to build relationships with Wage and Hour, Nebraska Workforce Development and OSHA's Regional and Area Offices to address health and safety issues, including noise, chemicals, machine guarding, ergonomics, weather related hazards and the use of PPE.
OSHA, Workforce Development, Wage & Hour, 21(d) OSHA Consultation, NGCSA, NPLCA and STMA will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise others awareness of and demonstrate their own commitment to workplace safety and health whenever OSHA, Workforce Development, Wage & Hour, 21(d) OSHA Consultation, NGCSA, NPLCA and STMA leaders address groups.

  • Convene or participate in forums, round table discussions, or stakeholder meetings on exposure to landscaping and lawn care industry issues such as noise, chemicals, machine guarding, ergonomics and weather related hazards and use of PPE to help forge innovative solutions in the workplace.
OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of OSHA, Workforce Development, Wage & Hour, 21(d) OSHA Consultation, NGCSA, NPLCA and STMA will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
