AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
HOUSTON SOUTH AREA OFFICE
AND
THE NEW MEXICO ENVIRONMENT DEPARTMENT –
OCCUPATIONAL HEALTH AND SAFETY BUREAU

The Occupational Safety and Health Administration (OSHA) – Houston South Area Office (HSAO) and THE NEW MEXICO ENVIRONMENT DEPARTMENT - OCCUPATIONAL HEALTH AND SAFETY BUREAU (OHSB) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. The HSAO and the OHSB hereby form an Alliance to provide their employees and other appropriate parties with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing exposure to Process Safety Management related issues. In developing this Alliance, the HSAO and the OHSB recognize that State Plans are an integral part of the OSHA national effort and will strive to ensure that this collaboration will only enhance that effort.

The HSAO and the OHSB will work together to achieve the following training and education goals:
  • The Bureau will host a 1 – week Process Safety Management (PSM) training class in Santa Fe, New Mexico open to selected OHSB staff, selected OSHA Region 6 staff and other personnel.

  • The Houston South Area Office will provide staff and documentation to train and educate the OHSB staff on the basics of conducting a PSM inspection. The intended goal of the class would be to have the student graduate from the class with enough basic knowledge of PSM that they would feel comfortable entering a PSM covered workplace and conducting an enforcement inspection.

  • The HSAO will invite selected OHSB staff to Houston for the purpose of receiving hands on training in a PSM covered facility. This training might take the form of participation with the Houston South Area Office when they conduct a Voluntary Protection Program Audit of a PSM covered facility.

  • The HSAO staff will provide technical assistance by phone to the OHSB concerning PSM issues.

  • If both parties agree, the HSAO will provide staff to assist the OHSB in inspecting the petroleum refineries operating in New Mexico.
OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet or communicate at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.
