AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

The Occupational Safety and Health Administration (OSHA) and the Transportation Security Administration (TSA) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and TSA, hereby, form an Alliance to provide TSA employees at the Luis Muñoz Marín International Airport (SJU) with information, guidance, and access to training resources that will help protect employee health and safety by addressing airport passenger screening and baggage handling issues, particularly in reducing and preventing exposure to ergonomic, struck-by, crushed-in, electrical, and fall hazards. In developing this Alliance, OSHA and TSA recognize that OSHA’s State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA and TSA-SJU will work together to achieve the following training and education goals:
  • Work with OSHA to provide expertise in developing training and education programs on ergonomics, struck-by, crushed-in, electrical, and fall hazards and to provide expertise in communicating such information to employers and employees in the industry.

  • Deliver or arrange for the delivery of training sessions addressing hazards encountered by TSA employees during the performance of their regular duties.
OSHA and TSA-SJU will work together to achieve the following outreach and communication goals:
  • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information ( print and electronic media, electronic assistance tools such as OSHA’s Baggage Handling e-Tool- and OSHA’s and TSA’s web sites) to employers and employees in the industry.

  • Speak, exhibit, or appear at OSHA or TSA-SJU conferences, local meetings, or other similar events.

  • Promote and encourage TSA-SJU participation in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Program, and Consultation.

  • Share information among OSHA personnel and industry safety and health professionals regarding TSA-SJU best practices or effective approaches and publicize results through outreach by OSHA and through OSHA or TSA-SJU developed materials, training programs, workshops, seminars and lectures (or any other applicable forum).

  • Build a collaborative relationship with OSHA’s Regional Office and San Juan Area Office to address health and safety issues, including ergonomic, struck-by, crushed-in, electrical, and fall hazards.
OSHA and TSA-SJU will work together to achieve the following goals related to promoting workplace safety and health:
  • Raise others’ awareness of, and demonstrate their own commitment to, workplace safety and health whenever TSA-SJU leaders address groups.

  • Develop and disseminate case studies illustrating the business value of safety and health and publicize their results.

  • Convene or participate in forums, round table discussions, or stakeholder meetings on airline and airport safety issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.
This Alliance provides TSA-SJU with an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education; outreach and communication; and promoting workplace safety and health. These Alliances have proven to be valuable tools for both OSHA and its alliance participants. By entering into this Alliance, OSHA is not endorsing any of TSA-SJU’s products or services; nor does OSHA enter into this Alliance with the purpose of promoting any particular TSA-SJU product or service.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of this Alliance.

All commitments made by the Federal signatory agencies to this Alliance are subject to the availability of appropriated funds and each agency’s budget priorities. Each party will pay for its own expenses in participating in this Alliance. Nothing in this Alliance establishes any requirement for one of the parties to reimburse any of the expenses of any other party.

This Alliance is neither a fiscal nor a funds obligation document. Any endeavor involving reimbursement or contribution of funds between the parties to this Alliance will be handled in accordance with applicable laws, regulations, and procedures, and will be subject to separate subsidiary agreements that will be effected in writing by representatives of all parties.

Nothing in this Alliance is intended to diminish or otherwise affect the authority of any agency to carry out its statutory, regulatory, or other official functions. Nothing in this Alliance is intended to create any right or benefit, substantive or procedural, enforceable by any party against the United States, its agencies, their officers, their employees, state agencies, or officers carrying out programs authorized under federal law, or any other person.

Nothing in this Alliance is intended to conflict with current laws or regulations or the directives of the Department of Homeland Security, TSA, OSHA, or any other Executive Department. If any term of this Alliance is inconsistent with such authority, then that term shall be invalid, but the remaining terms and conditions shall remain in full force and effect.

This Alliance will remain in effect for two years. Either signatory may terminate this Alliance for any reason at any time, provided they give 30 days written notice. This Alliance may be modified at any time with the concurrence of both signatories.
