AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
UNITED STATES DEPARTMENT OF LABOR
ALBANY AND TARRYTOWN AREA OFFICES,
THE NEW YORK STATE DEPARTMENT OF LABOR
DIVISION OF SAFETY AND HEALTH
ON-SITE CONSULTATION PROGRAM,
THE NEW YORK STATE NURSERY AND LANDSCAPE ASSOCIATION,
THE NEW YORK STATE TURF AND LANDSCAPE ASSOCIATION,
AND
THE PROFESSIONAL LANDSCAPE ASSOCIATION OF ROCKLAND COUNTY

The Occupational Safety and Health Administration (OSHA), the New York State Nursery and Landscape Association (NYSNLA), the New York State Turf and Landscape Association (NYSTLA), the Professional Landscape Association of Rockland County (PLARC), and the New York State Department of Labor’s Division of Safety and Health On-Site Consultation Program (NYS Consultation) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA, NYSNLA, NYSTLA, PLARC, and NYS Consultation hereby form an Alliance to provide NYSNLA, NYSTLA, and PLARC members and others with information, guidance, and access to training resources that will help them protect employee’s health and safety, particularly in recognizing, reducing and preventing exposure to industry hazards such as amputations, unstable excavations and trenches, and energized power line hazards.

In developing this Alliance, OSHA, NYSNLA, NYSTLA, and PLARC recognize that OSHA’s New York On-Site Consultation Program is an integral part of this Alliance and the OSHA national effort.

OSHA, NYSNLA, NYSTLA, PLARC, and NYS Consultation will work together to achieve the following training and education goals:
  • Work with OSHA to provide expertise to develop landscaping, nursery, arborist, and allied industry safety and health training and education programs addressing:

    • amputations
    • falls
    • caught between
    • struck-by
    • electrical
    • work related musculoskeletal disorders
    • personal protective equipment
    • immigrant workers
    and to provide expertise in communicating such information to employers and employees in the industry.

  • Work with OSHA to provide expertise to develop specific training and educational tools designed to:

    • identify work-related hazards using various processes such as: safety assessments, compilation of members’ experiences, and data analysis
    • review and update NYSAA, NYSNLA, NYSTLA, and PLARC member’s understanding of applicable OSHA standards, to include:

      • Machine guarding
      • Fall Protection
      • Working near energized power lines
      • Ladder Safety
      • Hazard Communication
      • Trench and excavation safety
  • Work with OSHA to provide expertise to develop workplace safety and health “best practices” guides for NYSNLA, NYSTLA, and PLARC, and NYS Consultation will work together to achieve the following outreach and communication goals:

  • Work with OSHA to provide expertise to develop and disseminate information through print and electronic media, including electronic assistance tools and links between OSHA’s, NYSNLA, NYSTLA, and PLARC Web sites.

  • Speak, exhibit, or appear at OSHA, NYSNLA, NYSTLA, and PLARC seminars, workshops, and conferences, such as the Annual Empire State Green Industry Conference.

  • Share information among OSHA personnel and industry safety and health professionals regarding NYSNLA, NYSTLA, and PLARC best practices or effective approaches and publicize results through presentations by NYSNLA, NYSTLA, or PLARC and through OSHA or NYSNLA, NYSTLA, and PLARC - developed materials, training programs, workshops, conferences, or other applicable forum
OSHA, NYSNLA, NYSTLA, PLARC, and NYS Consultation will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise others’ awareness of, and demonstrate their own commitment to, workplace safety and health whenever OSHA, NYSNLA, NYSTLA, PLARC, and NYS Consultation leaders address groups

  • Develop and disseminate case studies illustrating the business and social value of workplace safety and health, and publicize their results.

  • Convene or participate in forums, round table discussions, or member meetings on occupational hazards including amputations, falls, caught between, struck-by, energized power lines, work-related musculoskeletal disorders, and personal protective equipment to help forge innovative solutions in the workplace
The New York State Department of Labor On-Site Consultation Program will provide resources, as necessary and available, to support the training and technical assistance needs of the participants of this alliance. Such assistance may be in the form of on-site consultation visits and/or occupational safety and health training. Findings from any on-site consultation surveys will be kept confidential, so long as the requesting employer agrees to correct any serious hazards that may be identified. There is no cost to the alliance participants for any assistance provided by the On-Site Consultation Program.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

An implementation team made up of representatives of all signatories to this Alliance will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. At least one of these meetings will be in person.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
