AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE U.S. DEPARTMENT OF LABOR
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION’S
MANHATTAN AREA OFFICE
THE NEW YORK STATE DEPARTMENT OF LABOR
DIVISION OF SAFETY AND HEALTH ON-SITE CONSULTATION PROGRAM
AND
THE MANHATTAN HISPANIC CHAMBER OF COMMERCE

Occupational Safety and Health Administration Latin American Workers Project, Inc.

The Occupational Safety and Health Administration (OSHA) and The Latin American Workers Project, Inc. (LAWP) recognize the value of establishing a collaborative relationship to foster safe and more healthful workplaces. OSHA and LAWP hereby form an Alliance to provide LAWP members and others with information, guidance and access to training resources that will help protect the health and safety of Hispanic day laborers, who are not proficient in the English language from construction industry hazards such as falls from heights, electrical, struck by, caught in between and excavations.

OSHA and LAWP will work together to achieve the following training and education goal:
  • Provide onsite training to day laborers at their shape up sites on workplace health and safety hazards such as working at heights, electrical, struck by, caught in between and excavations.
OSHA and LAWP will work together to achieve the following outreach and communication goals:
  • Jointly exhibit and disseminate safety and health information at events such as community based-forums, through electronic media and the organization’s quarterly newsletter.

  • Make available to potential employers and the day laborers safety and health publications, audio-visual and other reference materials that are in Spanish.

  • Increase access to safety and health training resources and related materials in Spanish for Hispanic day laborers who are not proficient in the English language.

  • Work with community and faith-based organizations and other leadership groups to build a safety and health awareness culture within the Hispanic community.
OSHA and LAWP will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise others’ awareness of and demonstrate their own commitment to workplace safety and health whenever leaders address groups.
OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action and identify roles and responsibilities of the participants. In addition, they will meet quarterly to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.
