P07-09 FROM: KEVIN STRICKLIN  Acting Administrator for Coal Mine Safety and Health SUBJECT: Single Source Coal Reporting Pilot Program Scope This program information bulletin (PIB) applies to all coal mine operators, miners and miners' representatives, Coal Mine Safety and Health Administration (MSHA) enforcement personnel, and other interested parties within the mining industry. Purpose This program information bulletin announces a pilot program whereby coal mine operators and contractors can meet multi-agency filing requirements by submitting a single mandatory filing through the Single Source Coal Reporting (SSCR) Program. Information MSHA has entered into an agreement with the Department of Interior's Office of Surface Mining (OSM) to allow coal operators and contractors to file multiple documents through one agency (OSM) who will, in turn, disseminate this information to the other affected agencies by the 31st day following the end of each calendar quarter. MSHA will consider participation in this program when determining reporting compliance when documents are submitted directly to OSM as part of this pilot program. At 30 CFR, Part 50.30 Subpart D - Quarterly Employment and Coal Production Report, 50.30-1 (a) states in part that MSHA Form 7000-2 is to be submitted to MSHA's Office of Injury and Employment Information (OIEI) within 15 days after the end of each calendar quarter. MSHA has allowed companies to file electronically within 25 days after the end of each calendar quarter and be considered timely. However, operators who are participating in the SSCR program will have until the 31st day after the end of each calendar quarter to file their reports with OSM. Operators will significantly reduce their reporting burden by reporting their quarterly employment and production data directly to OSM. By doing so, it reduces their responsibility of reporting this information to three separate entities. The OSM will then disseminate this information to other agencies that have entered into this Single Source Coal Reporting agreement. Additionally, this will reduce the administrative burden on the operator by minimizing the amount of time spent on reporting this information to multiple agencies as well as costs spent for paper and postage. Background As part of the Business Gateway initiative, the Department of Interior's Office of Surface Mining (OSM), in partnership with other Federal and State agencies, has launched a Business Gateway pilot for Single Source Coal Reporting (SSCR). SSCR is an initiative to streamline the reporting of coal mine employment and production information by consolidating, automating, and simplifying the data reporting requirement for various governmental agencies. While all governmental agencies that require coal reporting are potential partner agencies, the current partner agencies include OSM, MSHA, Department of Treasury's Internal Revenue Service (IRS), the Pennsylvania Department of Environmental Protection (PA-DEP), and Virginia's Department of Mines, Minerals and Energy (VA-DMME). Possible future partners in SSCR include the Bureau of Land Management, Minerals Management Services, and EIA (Energy Information Administration). In regard to MSHA's Part 50 enforcement efforts, there has been some confusion by both inspectors and operators concerning MSHA's reporting period for participants in the SSCR. By entering into this initiative, MSHA hopes to standardize the reporting period for the Quarterly Employment and Coal Production Reports (Form 7000-2) for operators or contractors who are participating in the SSCR program. MSHA can assure those entities that if their 7000-2 forms are received by the 31st day after the end of each calendar quarter, they will be considered in compliance with the reporting requirements.
