• Article 98 Agreements and the International Criminal Court

Office of Security Negotiations and Agreements (PM/SNA)

The mission of the Office of Security Negotiations and Agreements (PM/SNA) is two-fold:

• To facilitate the deployment of U.S. military forces anywhere in the world to meet the nation's security requirements.

• To protect U.S. nationals and current or former service members from surrender to the International Criminal Court (ICC) without the consent of the United States Government.

To accomplish this mission, PM/SNA is responsible for negotiating Status of Forces Agreements, Defense Cooperation Agreements, burden-sharing agreements, and Article 98 agreements. The first three types of agreements support the deployment of U.S. forces abroad and often also support the Global Defense Posture Realignment (GDPR), while Article 98 agreements address the International Criminal Court. PM/SNA literally covers the globe: the office has recently concluded Special Measures Agreements (burden-sharing) with the Republic of Korea and Japan, and a defense access agreement with Romania. The latter represents the first time U.S. military forces, albeit in small numbers, will be stationed in a new NATO ally that is also a former member of the Warsaw Pact. Other negotiations are taking place in southeastern Europe, South and Central Asia, Northeast Asia and Africa, with upcoming sessions in Latin America and North Africa. PM/SNA relies heavily on expertise provided by the Office of the Secretary of Defense (OSD)/Policy, OSD General Counsel, the Joint Staff, regional bureaus and the Office of the Legal Advisor/Political-Military Affairs (L/PM) at State, and Embassies and the Combatant Commands.
