USCIS and FBI Achieve Interim Backlog Elimination Goals

We’ve met another benchmark in our efforts to eliminate the FBI Name Check backlog.

As of mid-February, USCIS and the FBI had completed all name checks that were pending for more than six months. In doing so, we beat our publicly stated goal by almost two full weeks. With the milestone’s completion, the FBI and USCIS have met or exceeded the first six milestones outlined last summer.

And that might not be the most exciting news. We’re on track to meet our May 31 milestone of completing name check requests pending longer than 90 days. By the end of June, the FBI will complete 98-percent of USCIS name check requests within 30 days and process the remaining two percent within 90 days.

Let me put that into perspective. At the beginning of November 2007, there were nearly 350,000 pending name check requests. Of that total, more than 54,000 had been pending for more than two years. Another 55,000 had been pending for at least a year. Today, there’s a grand total of 6,756 pending name check requests. And of that number, not one has been pending for more than six months. In fact as of that February 17 snapshot, the FBI was completing 99.2 percent of all requests in less than 30 days.

The results speak for themselves. The effective elimination of the name check backlog means that USCIS can make more timely decisions about immigration applications and petitions. That includes cases with derogatory information and those that are otherwise approvable. In both the present and the future, USCIS and the FBI will continue to focus on sustaining the rigorous and efficient screening of each name check request. Our joint attention to eliminating the name check backlog will ensure we reward deserving, eligible applicants with benefits like U.S. citizenship and permanent residency in a more timely manner.

  • I wish I could be as happy as Acting Deputy Director Mike Aytes. I have a client and a friend who has been waiting for her FBI clearance for more than "2 years". Her entire family has obtained their green cards and this mother of 2 young girls is still waiting without knowing what is wrong. We cannot attain a straight answer except FBI pending. Could someone please help us so that this mother can feel complete and less worried about her future?

  • Thank you! Thank you! and Thank you!

This is so great! The best thing ever happened for immigrants in recent years! And this is great for this country too!

Is this possible to get name check result using online status check? Right now applicant can only get this information from infopass. It could be very convenience to do it online, otherwise I have to take a day off to drive to the nearby city for infopass.

    Thanks you.

  • It's a commendable achievement by USCIS. But we should be careful before celebrating since sometimes the processing report does not reflect reality and it should not be a PR exercise like what texas service center does.If one see the TSC 140 processing they are ahead in processing 140 , but reality is they have a huge backlog for july aug. For TSC they process randomly and is like a lottery. Is anyone watching what is happening in TSC?.Even online status check also is broke for TSC.

  • Can you comment on your efforts to eliminate the backlogs on pending labor certifications? I have been stuck in this phase for the past two years in my green card process even though I applied through the perm method since I received my graduate studies in the US.

    Thank you.

  • Mr Aytes,

Kudos to you and your staff in acheving your SLA's.

But the damage has already been done Mr Aytes. 225,000 visas have not been used over the past 10 years mainly because of namechecks and other issues at USCIS. Folks such as my self who has been in the US for 10 years now (legally) will not benefit because of this. My name check, probably, is complete but there is no visa number available and the dates have retrogressed to stone age.

The irony is your department refuses to provide an accurate representation of the backlog. No matter what kind of legacy systems/databases you are running, your analysts should be able to provide how many EB applications are pending per quarter per category and country. State department has clearly lamented on the backlog and how USCIS refuses to provide a picture on this in Oct 08 bulletin.

Every year when the final Q of the USCIS/DOS fiscal year comes, the dates jump so much only to make it easy for applications to be picked randomly and come octm they go back to stone ages and remain there for another 3 quarters. we are tired of playing this lotto and I hope you will look into this.

SCOPS chief Barb Velarde has hired a program manger to work with DOS to utilize visa numbers effectively. How about providing a visa number usage report along with your monthly processing times? If you really want to make immigration easier, these are the kind of things that your organization might want to do. There is no transparency what so ever and the processing times for a month will be updated after a month. What is the point in having the Mar 15th processing times posted on Apr 15th?

By Anonymous Anonymous, At March 20, 2009 1:52 PM

  • The processing times for the Texas Service Center, are they accurate or not? For I-485 applications, July 26, 2007 has been posted as the processing date for the last 3 months.

  • Bravo! I'm waiting for my Citizenship Oath Ceremony from 12-08-1998. The FBI have pending the certification of my fingerprints for over 11 years.

    Thank President Obama, Thank USCIS!

By Anonymous Anonymous, At March 20, 2009 2:45 PM

  • Really, Great news for some. But is it really work that way or just look good on paper, my application is still pending for decision after waiting of over almost 3 years since application for naturalization and over 10 months after passing citizenship interview and getting recommendation for naturalization from interviewing officer. Law at the bottom of that notice says, decision should be make in 120 days of that interview, but who makes law, who follow it, atleast not USCIS.

As someone said earlier, NO TRANSPARENCY, no law, I wish someone really do something about it too.

By Anonymous Anonymous, At March 20, 2009 3:08 PM

  • Orlando according to the bulletin from uscis 2008 shows a processing time of 18 months for citizenship ( n400) applications which is terrible compared to some local offices like palm bay ( 8 months processing time)...does that mean the improved time of FBI name checks will improve processing times for n400? this is one of the concerns the public wants answers to.

By Anonymous Anonymous, At March 20, 2009 3:12 PM

  • I am really happy that this process is speeding up.This means probably I might not need to wait another 5 years to become a permanent resident via my father's petition.I cannot wait to truly soar and experience what it means to be a true part of this Great Nation!

My case is been processed at the Texas Service Center and I went for GC FP in Nov 2007. If my namecheck was cleared shouldn't my LUD be current ? It still show LUD Oct 2007. Any comments on that one?

I Don't know what else to do a writ of mandamus is probably the way to go, I feel discrimated by USCIS

  • How will this news affect the I 130 petitions, would it facilitate the process or be just the same slow process. How do we know the exact dates being processed when you do not post it, I don't understand your "6 months", FROM when TO when shall it start and end and what does it cover. BE TRANSPARENT PLEASE so that we can at least monitor how is our petition/cases going. My petitions for my 2 less than 21 year old daughters were filed NOV. 7, 2007 with received date of January 18, 2008, HOW IS THIS???? I've petitioned my wife 2-3 weeks late than my 2 daughters but she received her NVC notice only after 3 months and been here in US since last year. I don't understand why that of my 2 minor daughters cases are having a hard time.

Such split family cases are in abundance which is against the spirit of LIFE act passed by congress. Such cases should have been given top priority.

  • Dear Mike.

You have done a wonderful job, very good, now how about doing something about the backlog with I-130 brother/sister petition case, my case is pending since May 2000,every time when I check the processing site the date is the same, for around 4-5 years now it stuck into Febuary 25, 2001, can someone look into the matter and tell the public the truth or what is going on?

By Anonymous Anonymous, At March 22, 2009 2:37 PM

  • I don't mind you speeding up "backlog" as long as you TAKE NO SHORTCUTS!

As a citizen of the United States I demand the DHS contiune worksite enforcment raids and save Amercian jobs for legitimate workers ONLY!

There is NO EXCUSE for allowing any illegal alien to stay in an illegal job, that an American Citizen can have!

12 Million Amercians cannot find a job!
7 Million illegal aliens do have a job!
    That is just plain wrong!
DO YOUR JOB! DO YOUR JOB!

  • Dear Mr. Aytes:

While it is paramount that this mile stone of FBI name checks has been completed as stipulated between the USCIS and the FBI, yet an important question remains. How long would it take the USCIS and its IT department to start completing and updating cases that have been pending for those significant periods of time to reflect reality? Many families are hurting after visiting and discovering from the USCIS Web site that their case(s) priority dates are out side the normal processing time. And when these case applicants call the USCIS 1-800 375 5283 to inquire about the case status and processing times, the response they receive is virtually similar to what the web site have on each and every one of those cases.

One of the primary reasons given by the USCIS for increasing the filing fees for most applications and petitions in the Fall of 2007 was to hire more hands in order to address and/or hasten the reviews and completion of those hug workload of backlogs in the USCIS system. Yet, since those increases in administrative costs on August 2007, there have not been a whole sale changes that reflect such administrative maneuver in its monthly updates of “Case Status Online” and “Processing Times” in the USCIS web site. One thing is to get those FBI name checks taken care of; another thing is to follow up with completion of the long waited backlogs of cases with the USCIS.

Without doubt, Mr. Aytes, you and your good office has achieved something great with the clearance of FBI names checks. But we would like to see rapid changes in the completion of those long awaited petitions and applications that have been in the USCIS system for over two years or more. As the adage says, “A play full of witty tactics says of the land.”

  • You know it is unfair how immigrants are treated just to obtain a green card in american. It cost a leg and a arm and some cases after you pay all this money there is no guarantee that you will obtain green card. The spanish people don't have to go through all this drama but everyone esle has to. This seems like a money making machine. Anyway, i hope i will get a green card sometime soo, because i have 2 kids here and my husband and i really wouldn't like to go back to my country considering the fact that i don't have a home to take my kids to. America is still a good country and i hope things will get better soon for everyone.

  • I am one of the ones who had had "pending name check" status for 4+ years, but at last it was processed recently (after a 4.5 yrs wait). The milestones have definitely been met as far as I am concerned and you guys are doing a great job. Keep up the good work! To those who are somehow still awaiting a decision on their namechecks, please be patient and let these guys do their work. I know from customer's standpoint, it's extremely frustrating to have to wait for years in some cases but you gotta understand that namechecks are important steps in the immigration applications processing. This is one of those scenarios where the depts mantra is "better late than sorry". And I can't help but side with the dept.

It's like a cloud hanging on my head, can't make decision to buy house or settle down .
USCIS knows the shortage of nurses then why our case files are collecting dust sitting in their office.finishedthe pending cases then take new cases .seems like its just money making business and unnecessary stress to innocents legal workers.

  • I would also like to know how I can find out whether by case is being held up for FBI background check

By Anonymous Anonymous, At March 24, 2009 7:57 PM

  • I am glad to see that the name check problem has finally been solved. However there remains many victims including myself. My N-400 case was delayed 2 years (nc took 2 years + 8 month processing = 2yr 8m total) which effectively has delayed my I-130 petition case and my wife is still not here. We have just passed our 2nd anniversary apart. I think I deserve faster processing on my I-130 given the unreasonable two year delay. An excessive name check delay should be eligible for expedited service. (even though the delay came from another case such as N-400) USCIS needs to be cognitive and responsive to such cause-effect situations.

  • Dear Mr. Aytes,

My husband's I-130 petition was received 01-19-07 and is still pending the FBI Check. I have (6) minor children, ages 5, 8, 10, 12, 14 and 16 years respectively. I am raising six children in the very costly Washington DC area as a single parent. I have no immediate family in the area. Meanwhile, my husband waits in Jordan for his FBI check to be completed and his case to be approved. My children and I have waited over 2 years without a father and husband.

My six children and I are all born American Citizens. Please expedite this case. My family needs help as soon as possible. Thank you for your consideration. S.Jaradat

  • Ateast the poblem is being resolved. I understand, it can be very frustrating. And for the most part I don't think they really understand how important it is to us. Sometimes it just feels like your life is on a standstill. Kudos and lets all hope for the best. After all good things don't come easy.

Thank you for you hard work!

  • This is no news. Another attempt to make them look like they're doing something about it. When there are no other backlogs in the whole process then I might come and shake your hands. Till then, you've taken a lot of money (giving you jobs might I add), and no results. Ask the many that has been waiting 5, 6 ,7 or more years. Go ahead. Ask them.

  • My fiancé (American citizen) and I (Peruvian) applied for a fiancé visa on September 2008.We have been waiting for the NOA2 for more than six months and we just receive a letter that says that our process is pending because they are doing some backgrounds checks of my fiancé (American citizen). For what I know in k1 visa NCV is the one who check the name no USCIS and it is only for the beneficiary not for the petitioner.
For me it seems like they didn’t even look for my file because we gave them lot of proof of our relationship and neither of us has records, so I don’t understand why it is so complicated.
I am scary that it will take months or even years to be with my fiancé. Did somebody know what can I do to speed the process or get in contact with somebody at USCIS. We already contact a congressman but USCIS keep saying that they are waiting for name checks. So unfair !
If somebody can help me, here is my e-mail :ineschiarella@hotmail.com
    Good luck to every one!!

Why don't they start expedite processing for these cases and take moneyfrom customer which we are paying to attorneys, so they can pay more worker and do security check more effectively and faster.

  • Presumptuous that NNCP is the hardest part in the whole process for Permanent Resident, and USCIS along with FBI can complete NNCP in a timely manner. Then we should also have reason to expect that USCIS can adjust I-485 cases in a timely manner as well, maybe even in a more timely manner. But this is not happen yet. Still this is a very good news for most of us, hopefully for everybody, and it's a good job of USCIS and FBI, but more needs to be done from USCIS in the near future. Otherwise, we might need to wait for more years worrying about future, which is a burden on families.

(We can't blame the third world if they don't find solutions for their problems). It's so easy to manage all the backlog problems if USA wants to, but the truth she doesn't want to find any solution . This is a business going on, we don't know till what time. We have to wait ....or loose hope ...and leave.

  • Thanks to the staff of NNCP for speedy clearance of back log many families relieved with the news. Now the posts and NVC should give top priority to virtually separate husbands and wives and minor children in the true spirit of LIFE act to speed up processing on top priority. I was sad to read multi-pronged miseries of many families victim of this delayed name check process.

By Anonymous Anonymous, At March 28, 2009 3:09 AM

  • In view of LIFE act the NNCP should also categorize the Family priority in accordance with the NVC priority of F-1, F-2, F-3 etc. so that split families should not suffer long waiting times.

But every time I contact them I hear a script.. Call back when it is over the alloted time 6 months.. So I call 1 day after 6 months and the put in a order to asked why?? And I got a letter telling me if I have NOT HEARD nothing in 6 months to give them a call??? So I call immigration again and they tell me I must wait 60 days.. If they can not do the job then give them to people that can.. AND why are tax dollars paying for people to read scripts and can not help you at all??
I am a US citizen and get treated like I was born in Iraq.
I had a secret, top secert, and special cat. Clearence in the military and it took them all of 4 weeks to get those and now to get my family here I must go through this.. It has been almost a year now since I have seen my family.. But immigration is happy to go home to theirs each night..
I even wrote my senator and they got the same letter as me..
If you got Obama's address or email I will write him too... Something needs to be done from the top down.

  • While i am pleased that the FBI and USCIS were able to catch up on this enormous log of name check background requests I am astonished as to how this problem occurred in the first place. I am very curious as to how this huge queue of names was allowed to accumulate in the first place. Was the FBI's name check division merely understaffed and underfunded? Or was there a serious flaw in your operation design? Most importantly what did you do to correct the problems? It's all good and well to focus your efforts and eliminate the huge back log of name check requests but if you dont address what caused the problem this will merely happen again further down the road and delay the American Dream for many deserving immigrants who are trying to enter this country and gain their citizenship legally. I also hope the FBI is prepared for its requirement in fulfilling the Census Bureau's biometric background checks for the upcoming 2010 Census. A delay by the FBI to check the 1.4 million Census applicants can and will severely hinder the Census taking effort costing our country potentially billions of dollars.

  • What a USELESS branch of the U.S. Government the IMMIGRATION Department (USCIS) turned out to be. It's been two years since I've filed my AOS for my family and I. Paid the money to the lawyer and Immigration. And after all the hard work to get this far. I am still waiting for a simple approval. I could have gone to Cuba. Hopped on a boat. Washed up in Miami and get my Permanent Residency and Citizenship faster. But I guess the legal way is much more complicated.

Texas Service Center case processing has been stuck at June 2007 forever. Is anyone working at the TSC??? Why is there a delay for EB3 applicants. Do the State Department and USCIS know the impact their lack of effective management is having on ordinary people who just want to get on with their simple lives???

  • Every speech given by an official from the USCIS for the last ten years emphasize the great work, progress, and achievement made by them solving cases and backlogs. If that is the case, how come there are still a backlog in I-130, I-485, MTR, and Appeal cases? Is there going to be a day when all backlogs are over? My suggestion is that USCIS should pay their adjudicators salaries on merits. The amount of cases successfully cleared and processed per month will determine their paychecks. This will make them get of their butts and do some work, just like any public servant in other countries like UNITED KINGDOM, where persons and immigarnts are treated with respect and integrity.

No criminal record. Once I contacted USCIS and a gentleman stated that when my husband goes to court in Dec. he will be required to pay a fine of $1,000 and then get his green card. I called USCIS again and asked if my husband would have to leave the USA and the young lady said that since we have a lawyer and his case is being heard in the USA and no criminal record probably not. I hope this is true. Does anyone know anything I should know?

  • LIFE act was passed by congress to facilitate split families specially the vital life partners husband & wife living apart in miserable stressful conditions the NNCP /USCIS should evolve some procedure to start the NNCP process the day I-130 form is received at NVC to save the spirit of LIFE act proving useless in present back log conditions. The Finger Prints can be taken at posts to be submitted alongwith I-130. Delays of years / months together are traumatic.

  • Dear Mr. Aytes:

Now that you and your good office are through with the FBI name check on hundreds of thousands of petitions and applications that had been pending for years, raging from one (1) to thirteen (13) years, as indicated by the various postings here in response to your article on the DHS-USCIS Leadership Journal, entitled: “USICS and FBI Achieve Interim Backlog Elimination Goals,” one important question remains. How many more months or years will it take you and your staff at the USCIS to adjudicate those cleared FBI name check backlog of hundreds of thousands of diverse petitions and applications?

One would wonder that if your USCIS office and the FBI have been able to accomplish this milestone within that short time period, then, it would take weeks, not months to adjudicate these long awaited cases that have been in your system for years--way beyond the normal processing time frame in the USCIS Web site. Besides, I would add that the USCIS Web site SHOULD be updated monthly to reflect reality. As it is now, it does not. While integrity matters to a great majority of people, institutions, and agencies in the United States, I hope it matters to USCIS as a branch of the DHS.

  • Dear Mr. Aytes
I born in US. I filled I-130 for my husband in 2007. Finally my husband was interviewed at US Embassy in Abu Dhabi last year. He have been waiting now for 6 months (AP, backgroung check). I don`t understand why we have to wait so long to get my family live with me in my contury and what`s the purpose of the IV if we have to wait that long. I hope we get a good news soon. Thanks

  • I remember when former USCIS director, EMILIO, during his tenure with the USCIS, worked so hard to clear most of the backlog of petitions and applications with the USCIS before he resigned or was perhaps, forced out. That man achieved more results in a short time he was in office as USCIS Director than any other director I’ve come to know.

But things have not been the same from the reign of director Jock Scheifer and his progeny. I wish President Barack Obama and Secretary of Homeland Security, Janet Napolitano would put in somebody like director Emilio again to speed things up for every petitioner or applicant who has her/his case pending for those significant time period now.

By Anonymous Anonymous, At April 13, 2009 11:30 AM

  • I agree with the lady whose husband is waiting for background check in Abu Dhabi, after interview since last six months, there is abundance of such split family cases, normally it takes 1 to 2 years to reach an interview stage at Post after wards the Administrative process takes another nerve shattering wait of months together it is negation of LIFE ACT, at least the spouses should have been put in speedy ques according to family priority criteria. I hope secretary of Home land security speed up such cases.

I cannot figure out what the FBI is looking for, it is only God who knows. Some friends that I assisted to file their papers in 2006 are on the verge of becoming citizens and I am still languishing with Work Authorization. I have had to renew my Work authorization for 4 years in a row and each time, the answer to my enquiries was, one Mr John at Memphis office is on an extended review of my case. What at all is he reviewing for 4 years and hasn't found out? I am not a criminal, never have been in trouble and neither was "wasteful" person in my home country befoe coming to the US. Immigration process has stalled or halted all plans I have in life and I still cannot figure out what to do. It's my prayer this enhance sevice delivery will result in the issuance of my Green Card.

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

  • You must note that I've received numerous times this type of six months nonsense answer from the USCIS. In fact, I would want real answer, not this standardized statement laid down to be copied and sent to petitioners/applicants every time they inquire about their case status.

Please give me real answer to my inquiry: When is this six months additional review thing going to be over for my Form I-730, Asylee/Refugee relative petition which was filed on MARCH 13, 2007?

What about the FBI/USCIS clearance of backlog as advertised in the leadership journal by acting deputy director, Mike Aytes that no more backlogs for cases filed more than 90 days old? You guys at the USCIS are funny with this ONLY SIX MONTHS ANSWER to inquiry about petitions outside the normal processing times for over two years now.

I'm really frustrated with this stupid SIX MONTHS ANSWER and I don't believe I will ever get a real answer from anybody from the USCIS due to this lack of trust and integrity in its dealings with some of its customers. It is a shame that things are taking so long for some petitioners/applicants and move so quickly for others.

  • Thanks USCIS for making me realize that am getting juiced by a money making machine. If i had 7 million people just renewing their EAD for $300 each year; that is 2 billion dollars into my pocket every year, i too would not want to give that up easily. For us families who are waiting and frustrated with this entire system, this is good news director aytes but too often your department have come up short on their word....why does it still feel the same this time?

  • Mr. Director, thank you for the is window, I have been waiting for my name check for 5 months now, what is up? The information above stated you guys were/are doing a great job regards the name check staff. I have been living here for 12 years now and went overseas for 150 days during this period. I have no moving violation not even parking ticket in the last 6 years. Could somebody advice the FBI to move forward with my case and send it back to USCIS. Our let the FBI call me if they stuck in something that does not make sense to them.

  • Hi, Mike Aytes, I strongly commend the efforts of USCIS & FBI in clearing backlog of name check processing, similarly at posts prior to issuance of Immigrant visa so called Administrative Processing takes months together with no time frame or limit. I am not whether both processes are interrelated / interconnected. This aspect also needs attention and the posts be advised to speed up the family based immig visas specially where husband & wife and children are split. These delays are not only causing financial difficulties but brewing multi- pronged social problems in shape of separations and divorces due long long waiting time and no time limit unlike processing time bulletins.

  • This is very good news for me. My case I-140 was already approved. Since october 2007. I'm waiting for further instruccions. I hope that my green card will be ready as soon as possible so that I can accomplish my goal to live and work in the USA. Hopefully most of the applicants who are waiting for results are also happy with this news. I wish you all at USCIS strenght and power to do your work. Thanks again and keep up the good work.

  • Mr., Director, good day, I am among couple of people who applied to become US citizen through Tampa, FL Office and have been waiting for 9-14 months now for our name check to be cleared. 100% of us are from the Middle East region. Could you please interfere and stop this profiling. We have spouses and kids waiting for over 5 years now to join us but it seems the suffering will never end. Please Mr. Director have mercy on us and asked Tampa local office or the FBI to give our name checks first priority. Our spouses and kids will never forget your help if you could.
