(WASHINGTON) -- The Commerce Department's Bureau of Export Administration (BXA) today imposed a $10,000 fine on Republic Cargo Systems (successor to certain of the business of H&M International Air Freight), located in Kearny, N.J., for allegedly violating the Export Administration Regulations (EAR), F. Amanda DeBusk, assistant secretary for Export Enforcement announced.
BXA alleged that, on or about November 24, 1992, H&M International Air Freight (H&M) exported marine diesel engine parts from the United States to Vietnam without obtaining from BXA the validated license required by the EAR. Most exports to Vietnam were embargoed during 1992. The investigation of the alleged violation was conducted by the Office of Export Enforcement's Boston Field office.
Payment of the $10,000 civil penalty is suspended for a period of one year and will then be waived, provided that, during the period of suspension, Republic Cargo Systems commits no violation of the Export Administration Act, or any regulation, order, or license issued thereunder.
BXA enforces export controls imposed for reasons of national security, foreign policy, nonproliferation and short supply. Criminal as well as administrative sanctions can be imposed for violations of the regulations.
In April of 2002 the Bureau of Export Administration (BXA) changed its name to the Bureau of Industry and Security(BIS). For historical purposes we have not changed the references to BXA in the legacy documents found in the Archived Press and Public Information.
