Time Standards


Processing Time Standards for Hearing Cases

The time standards are for litigating cases set for hearing were designed to process cases as quickly as possible, consistent with the due process and the Commission's requirement for a full and complete record. They provide for three separate tracks, depending upon the complexity and number issues involved a case:

  1. Simple Case;
  2. Complex Case; and
  3. Exceptionally Complex Case.

Time Standards for Discovery

These discovery time standards were designed to align discovery process time frames with the new time standards for hearing cases.

In some cases, particularly Track One proceedings, shorter periods for discovery may be required. In other cases, there may be good reasons for providing more time for discovery. In either case, the administrative law judge will have the discretion to adjust these time frames as required to meet the needs of the case.
