Advocating the Trust
Module Description
This module details many of the issues that may arise for courts and Public
Trust proponents, including the need to address prior holdings on Public
Trust cases, to strike a fair balance between public and private interests,
and to legitimize the testimony of experts in coastal-management-related
disciplines.
Module Objectives
After completing this module, you will be able to
- Explain how legislative acts and prior judicial opinions can hamper
courts while deciding Public Trust cases
- Provide strategies for overcoming past precedent and other legal obstacles
- Discuss the possible challenges associated with using expert witnesses
during a legal action
