Important Information Regarding Procurement under the Stimulus Package American Recovery and Reinvestment Act of 2009 (H.R. 1)

Appropriations as a result of the Stimulus Package are subject to the State Procurement Code (unless otherwise exempted).  Given the time restraints of this funding, prompt action should be taken to ensure the timely encumbering of funds.  To assist you we recommend the following:

  1. Review current state cooperative contracts and your agency contracts to determine if you can utilize these contract tools.
  2. When no contract exists, immediately contact the appropriate purchasing agent as soon as it is determined that funding will be received requiring a procurement process to encumber funds. Here is a link to our agents commodity assignments:  http://purchasing.utah.gov/directories/documents/agentlist.pdf
  3. Carefully review all funding requirements and address these in your procurement document.  Specifically be aware of the Buy American, Wage Rate Requirements, and Employ American Workers Act provisions listed in title XVI.
