FEMA Hazard Mitigation Assistance (HMA): Requirements for Property Acquisition and Relocation for Open Space
Recent amendments to Title 44 of the Code of Federal Regulations added a new Part 80, Property Acquisition and Relocation for Open Space. More detailed guidance to assist with implementation of the provisions found in Part 80 has also been developed. This property acquisition and relocation guidance is included in Section 2.3.13 of the FY09 Hazard Mitigation Assistance (HMA) Program Guidance and through the HMGP website. The property acquisition and relocation guidance must be read in conjunction with the overall program requirements for each HMA grant program, including the HMGP. The Part 80 rule and implementing property acquisition and relocation guidance are effective for all disasters declared on or after December 3, 2007 (12/03/2007). The property acquisition and relocation guidance replaces certain portions of the HMGP Desk Reference, Publication FEMA 345, dated October 1999.
