V. Primary Delegations Of Authority

The Secretary has delegated the following authorities to the Under Secretary, subject to certain reservations:

  • Authority to designate an office of the Department to coordinate departmental activities as they relate to the outlying areas;
  • Authority to act as an alter ego to the Secretary with respect to the development and implementation of policies to carry out the programs administered by the Department;
  • Programmatic authorities under the Elementary and Secondary Education Act of 1965, as amended (ESEA), as follows:
    • Title VII, Part A, Subpart 1 of the ESEA (20 U.S.C. 7421 et seq.), Indian Education Formula Grants to Local Educational Agencies
    • Title VII, Part A, Subpart 2 of the ESEA (20 U.S.C. 7441 et seq.), Special Programs to Improve Educational Opportunities for Indian Children
    • Title VII, Part A, Subpart 3 of the ESEA (20 U.S.C. 7451 et seq.), Indian Education National Activities
    • Title VII, Part A, Subpart 4 of the ESEA (20 U.S.C. 7471 et seq.), Indian Education Federal Administration

The Secretary has also delegated to all Principal Officers certain administrative authorities subject to certain reservations.
