The Intelligence Authorization Act of 2008 was not an up or down vote on outlawing waterboarding.  It was a vote that would have allowed terrorists to know how we interrogate our enemies, compromising our national security.

We train our troops to resist interrogation and so do our enemies.  This legislation would have forced our intelligence community to comply with the widely available and publicly accessible Army Field Manual.  This would give our enemies the information needed to dissect and resist our interrogation methods.  The Presided vetoed this bill and the veto override vote failed by a vote of  225-188.
