Creating an RFP for the Web

Using the RFP format outlined below, the Contract Specialist will create Streamlined RFPs in their word processing program. After the document is complete, it will be forwarded to the in-house individual responsible for formatting it for publication on the Web.

There are three basic methods for formatting documents for the Web:

HTML (Hyper Text Markup Language) coding is the preferred method. Formatting is retained, the document can be viewed directly from an internet browser, and it looks very clean. HTML documents may be printed directly from the browser. In addition, the document may be saved with a .TXT extension (converting it to ASCII DOS text); text may also be blocked and copied to a word processing program. If the Contract Specialist wishes to use HTML, but the expertise does not exist within their Institute:

a. Contact Ms. Sandy Desautels (402-6553) in DCRT. DCRT offers HTML file conversion service for a fee.

b. DCRT also offers HTML courses. Check their Web site for dates, times, locations, and cost (http://www.dcrt.nih.gov/csb/training/train.htm).

c. Use the newer version of a word processing program such as WordPerfect 7 or 8, or Word 97.

ASCII DOS text can also be used. Formatting is more limited and documents do not look as clean in an internet browser as HTML coded documents do. The document may be printed directly from the browser, the file may be downloaded to an individual's computer, or the text may be blocked and copied to a word processing program.

PDF (Portable Data File) is also available. Documents may be created in a word processing program and converted to .PDF using Adobe Acrobat PDF writer. Documents cannot be viewed or printed from an internet browser; they can only be viewed and printed using Adobe Acrobat Reader. All formatting is retained, and the document is similar to documents that have been scanned into a computer. The file cannot be copied to a word processing program.


Streamlined RFP

GENERAL OVERVIEW

A Streamlined RFP consists of the following 4 components:

  1. Streamlined Technical RFP
  2. Specific RFP Instructions and Provisions
    (Section L of the Uniform Contract Format)
  3. Applicable RFP References
    (Contains Section K of the Uniform Contract Format)
  4. Sample Contract Format, if applicable (Sections B-J of the Uniform Contract Format)

    The first component/section of your RFP, is the Streamlined Technical RFP. It includes the pertinent information about our requirement. Items typically included in a Streamlined Technical RFP are: Cover Letter/Solicitation Form; Statement of Work, with Project Background as applicable; Deliverable and Reporting Requirements; Evaluation Factors for Award, including Technical Evaluation Criteria; and, Other Information, as applicable.

    There may be up to three other components/sections, under an individual Streamlined RFP. One, entitled "Specific RFP Instructions and Provisions," provides specific information about a streamlined RFP and the submission of a proposal. These specific instructions and provisions (sometimes referred to as "fill in the blank" provisions) are ones which require specific input by the Contract Specialist. A complete listing of all potential specific instructions and provisions are outlined below in Specific RFP Instructions and Provisions. In addition, "Applicable RFP REFERENCES" identifies those items in the RFP REFERENCES directory that apply to your RFP. Finally, there may be a "Contract Format-Specific" RFP component/section that is includes a sample contract document which has been tailored to an RFP in cases where specific contract terms and conditions need to be highlighted in the solicitation process. In most cases, this component/section is not needed. Instead a Contract Specialist can reference the "Sample Contract Format- General" contained in the RFP REFERENCES under the NIH RFP Directory Web site.

    Note: All documents contained in the RFP REFERENCES subdirectory (i.e., Standard Instructions and Provisions, Optional Instructions and Provisions, RFP Forms and Attachments, Representations and Certifications and Sample Contract Format-General) will be maintained and updated as necessary by the NIH RFP Webmaster. Updates will typically occur when new FACs or policy changes are issued. Notification of updates to the RFP REFERENCES subdirectory will be sent via email to the Chief Contracting Officer of all participating ICs.

    Instructions and sample formats for creating each component of a Streamlined RFP are listed below. Contract Specialists are responsible for combining all of the above components into one electronic file (RFP) and sending it to your office's authorized representative who is responsible for posting it on the NIH RFP Directory web site. If, however, the Work Statement or another portion of the RFP (ie, Sample Contract Document) is extremely large, then the RFP could be placed on RFP Web site as more than one file and links may be placed within the main RFP document to join them. It is up to you and the requirements of your project. From the offerors' perspective, it is easier to go into fewer files to review and download, though it may be useful to offerors' technical representatives to have an exceptionally large Work Statement loaded separately.


    Streamlined Technical RFP

The remaining items in the Streamlined Technical RFP would come primarily from the Project Officer and the Acquisition Plan/Request for Contract would be:

Work Statement and Reporting Requirements Attachments

Note to Contract Specialist: Use the Work Statement, Deliverables, etc., from the Acquisition Plan/Request for Contract and include them as elements in the RFP you create. Use a horizontal rule to separate Streamlined RFP Attachments (ie, Work Statement, Reporting Requirements and Evaluation Factors for Award.


Evaluation Factors for Award, with Technical Evaluation Criteria

(Note to Contract Specialists: In most R & D RFPs, technical evaluation criteria will continue to be paramount as NIH seeks the highest quality in its scientific programs. These technical evaluation criteria typically are designed to look at such things as technical excellence, personnel qualifications, management capability, prior experience, and facilities. In addition, the reasonableness of individual cost elements is considered and the overall price is considered to ensure it is fair and reasonable, but unless technical proposals are equal, cost is not a selection factor in R & D RFPs. Consideration of past performance is often waived as a separate selection factor in R & D RFPs because this factor is inherent in many of the technical evaluation criteria. If past performance is not waived, then it may become an important factor if the award decision cannot be made using technical and/or cost factors.

The following language is an example of a typical R & D RFP approach. Also, included below is language for use when human subjects are involved or when mandatory qualification criteria are applicable. The actual technical evaluation criteria will come from the Request for Contract.)

Evaluation Factors for Award, with Technical Evaluation Criteria

  1. GENERAL

    Selection of an offeror forThe technical proposal will receive paramount consideration in the selection of the contractor(s) for this acquisition. All evaluation factors, other than cost or price, when combined are signficantly more important than cost or price. However, cost/price may become a critical factor in source selection in the event that two or more offerors are determined to be essentially equal following the evaluation of all factors other than cost or price. In any event, the Government reserves the right to make an award(s) to that Offeror(s) whose proposal provides the best overall value to the Government.

    The estimated cost of an offer must be reasonable for the tasks to be performed and, in accordance with FAR 15.305, will be subject to a cost realism analysis by the Government.

    Listed below are evaluation criteria. The evaluation criteria are used by the technical evaluation groups to evaluate the technical proposals and are listed in the order of relative importance with weights assigned for evaluation purposes.

    The evaluation will be based on the demonstrated capabilities of the prospective Contractors in relation to the needs of the project as set forth in the RFP. The merits of each proposal will be evaluated carefully. Each proposal must document the feasibility of successful implementation of the requirements of the RFP. Offerors must submit information sufficient to evaluate their proposals based on the detailed criteria listed below.

  2. This research project involves human subjects. NIH Policy requires that women and members of minority groups and their subpopulations must be included in the study population of research involving human subjects, unless a clear and compelling rationale and justification is provided with respect to the health of the subjects or the purpose of the research.

    Where inclusion of women and minority populations is not feasible, a detailed rationale and justification for exclusion of one or both groups from the study population must be submitted with the technical proposal. The Government will review the rationale to determine if it is appropriate with respect to the health of the subjects and/or the purpose of the research. If the rationale is not considered acceptable and you are included in the competitive range, you will be afforded the opportunity to further discuss and/or clarify your position during discussions or include women and minorities in your Final Proposal Revision (FPR). If your exclusion position is still considered unacceptable by the Government after discussions, your proposal may not be considered further for award.

  12. SAFETY AND HEALTH DEVIATION PHS 352.223-70 (AUGUST 1997)
    1. To help ensure the protection of the life and health of all persons, and to help prevent damage to property, the Contractor shall comply with all Federal, State and local laws and regulations applicable to the work being performed under this contract. These laws are implemented and/or enforced by the Environmental Protection Agency, Occupational Safety and Health Administration and other agencies at the Federal, State and local levels (Federal, State and local regulatory/enforcement agencies).
    2. Further, the Contractor shall take or cause to be taken additional safety measures as the Contracting Officer, in conjunction with the project or other appropriate officer, determines to be reasonably necessary. If compliance with these additional safety measures results in an increase or decrease in the cost or time required for performance of any part of work under this contract, an equitable adjustment will be made in accordance with the applicable "Changes" Clause set forth in this contract.
    3. The Contractor shall maintain an accurate record of, and promptly report to the Contracting Officer, all accidents or incidents resulting in the exposure of persons to toxic substances, hazardous materials or hazardous operations; the injury or death of any person; and/or damage to property incidental to work performed under the contract and all violations for which the Contractor has been cited by any Federal, State or local regulatory/enforcement agency. The report shall include a copy of the notice of violation and the findings of any inquiry or inspection, and an analysis addressing the impact these violations may have on the work remaining to be performed. The report shall also state the required action(s), if any, to be taken to correct any violation(s) noted by the Federal, State or local regulatory/enforcement agency and the time frame allowed by the agency to accomplish the necessary corrective action.
    4. If the Contractor fails or refuses to comply promptly with the Federal, State or local regulatory/enforcement agency's directive(s) regarding any violation(s) and prescribed corrective action(s), the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action (as approved by the Federal, State or local regulatory/enforcement agencies) has been taken and documented to the Contracting Officer. No part of the time lost due to any stop work order shall be subject to a claim for extension of time or costs or damages by the Contractor.
    5. The Contractor shall insert the substance of this clause in each subcontract involving toxic substances, hazardous materials, or operations.

    Compliance with the provisions of this clause by subcontractors will be the responsibility of the Contractor.


  13. TRAVEL REQUIREMENTS FOR SOLICITATION PURPOSES

    (In some cases there will be a need to specify the travel requirements that each offeror is expected to address. For example, in multi-center collaborative studies the number of trips per year and the meeting locations may be known in advance. This information should be provided to offerors so that cost differences from the Independent Government Cost Estimate in such areas are minimized.)
