"Per Diem" Appointments
Proposed Provisions
- Appointments will be made on a temporary basis with time limitations of two years. Extensions will be allowed on an indefinite basis.
- Appointments initially will be limited to US citizens, resident aliens and citizens of allied countries. If permissible, other non-citizens will be considered for appointment in a later phase of the program.
- Each per diem employee will enter into a written agreement that specifies the terms and conditions of the employment and the services to be rendered.
- Pay rates will be established by the CC Director to be competitive with practice in the relevant labor market. Generally, rates will be flat fees and will be paid for each hour of completed service. At the discretion of the Director, separate rates may be established for night and weekend work.
- Employees will NOT be covered by FLSA. No other overtime or premium pay benefits will be paid.
- Employees will be covered by Old Age and Survivor's Disability Insurance (OASDI) and Medicare deductions; no other retirement programs will be available.
- No medical or life insurance benefits will be extended.
- Employees will be eligible for absence without pay for birth, adoption, etc. No annual, sick or other paid leave provisions will be extended.
- Employees will not covered by any adverse action or grievance procedures.
- Upon separation, employees will not eligible for severance pay.
- Per diem employees will be subject to standards of conduct and conflict-of-interest regulations.
- Employment hours will accrue for computation of an employee's Service Computation Date.
- Employees will be covered by Federal Employee's Compensation Act (5USC, Chapter 81) and Federal malpractice protection.
- Compensation will be subject to Federal and state income tax withholding.
- Employees will be eligible for lump sum incentive awards.
- Employees will count against CC ceiling limitations based on a formula to be developed by the CC's Chief Financial Officer
- Suitability and security clearance procedures will be the same for these appointments as for competitive service appointments.
