Types of Premium Pay Available Under Title 38 Authority

- All Title 38 occupations are covered by T38 premium pay provisions for Overtime, Nights, Sundays and Holidays.
- On-call, Call-back and Saturday Differential are "special" Title 38 premium pays that are extended to specific occupations only after a needs determination has been made. The Title 38 occupational coverage chart identifies those occupations for which a special premium pay has been approved.
- Title 38 premium pay is in lieu of premium pay under Title 5. Note: When Title 38 is silent or ambiguous regarding payment of any of of the premium pays, internal VA regulations for Title 38 nurses and/or parallel authorities in Title 5 for GS employees will be used to determine appropriate payment.
- Employees in Title 38 occupations will receive applicable Title 38 premium pay(s) for hours of work that are scheduled and/or approved by a supervisor. All overtime hours must be ordered and approved in advance.
