Before you download the DocView software, you must agree to the following conditions in the DocView Software End User License Agreement. Then you must register online.
This Agreement sets forth the terms and conditions of your use of the accompanying DocView software product (the "Software").
By installing the Software from the National Library of Medicine, Department of Health and Human Services (hereinafter referred to as "NLM"), you (hereinafter referred to as the "RECIPIENT") agree to the following:
WHEREAS, the NLM was established by statute in order to assist the advancement of medical and related sciences, and to aid the dissemination and exchange of scientific and other information important to the progress of medicine and to the public health, (section 465 of the Public Health Service Act, as amended (42 U.S.C. section 286) and to carry out this purpose has been authorized to develop prototype systems that provide access to the biomedical literature;
WHEREAS, the NLM's Lister Hill Center has produced a new document retrieval, display and utilization software product called DocView;
WHEREAS, RECIPIENT desires to use the Software at its sole risk and at no expense to NLM;
The NLM hereby grants a nonexclusive license to RECIPIENT to use the Software to improve access to digital images or documents.
RECIPIENT may redistribute the Software in any manner whatsoever in order to assist the advancement of medical and related sciences, and to aid the dissemination and exchange of scientific and other information important to the progress of medicine and to the public health. This may include, but is not restricted to selling, leasing or giving it away free of charge to others. RECIPIENT agrees to acknowledge NLM as its source of DocView in a suitable and customary manner, but shall not in any way indicate that NLM has endorsed RECIPIENT or RECIPIENT’S use of the product or any product, service or company, and RECIPIENT shall indicate that no such endorsement should be inferred.
NLM makes no representation that use of the Software will not infringe on any patent or proprietary rights of third parties. RECIPIENT agrees that it shall be solely responsible for compliance with any third party copyright or patent restrictions; NLM assumes no responsibility or liability associated with use and/or reproduction of copyrighted, patented or other proprietary material by RECIPIENT or by any party receiving the Software.
Software is supplied AS IS without any accompanying services or improvements from NLM. NLM MAKES NO WARRANTIES EXPRESS OR IMPLIED, INCLUDING NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. All risk as to quality and performance of the Software is with RECIPIENT.
Neither NLM, the United States Government or its employees shall be liable or responsible to RECIPIENT in any manner whatsoever for damages of any nature whatsoever arising from this Agreement or from the use of the Software including but not limited to loss of data or data being rendered inaccurate, or losses sustained by RECIPIENT or third parties. RECIPIENT agrees to waive any and all claims against NLM and the Federal Government for liability resulting from errors in the Software.
