How do I get a document published in the Federal Register?

You must prepare the document in the format required by the Office of the Federal Register and send it and the appropriate number of copies to Jerry Moore, NIH Federal Register Liaison, Office of Management Assessment (OAM), Division of Management Support (DMS), 6011 Executive Blvd., Room 601, MSC 7669, Rockville, MD 20852, telephone (301) 496-4607 for transmittal to the Office of the Federal Register.

Where can I get guidance on the proper format to use?

You may consult with the NIH Federal Register Liaison, Jerry Moore, on (301) 496-4607, or you may consult the FR Document Drafting Handbook (October 1998 revision) available on line at http://www.nara.gov/fedreg/ddhhome.html.

Should I prepare my document on letter head paper or on plain bond paper?

All documents must be prepared on plain bond paper.

Can I send a document directly to the Office of the Federal Register for publication?

No, all documents published by NIH must be transmitted to the Office of the Federal Register by OMA/DMS.

Does NIH have to clear any notices with the Department and/or OMB prior to their publication in the Federal Register?

Yes. In accordance with the requirements of Executive Order 12866, Regulatory Planning and Review, we must obtain clearances from appropriate OS officials and OMB for certain documents before we can send them to the Office of the Federal Register for publication. For example, we must obtain pre-publication clearances for all program announcement notices (a.k.a. funding notices) and other notices that may raise novel legal or policy issues arising out of legal mandates, the President's priorities, or the principles set forth in E.O. 12866.

How long does it normally take to have a document published?

After a document leaves NIH it normally takes 3 - 4 working days until it is published.

How do I know when my document has been published?

There are a number ways to find out when your document has been published. You may request notification of the publication date when you submit it to OMA/DMS for processing. You may call the NIH Federal Register Liaison, Jerry Moore, at (301) 496-4607, to determine when the document is likely to be published and then check the Office of the Federal Register's website on the appropriate date.

How do I get a copy of my published notice?

You may call the NIH Federal Register Liaison, Jerry Moore, at (301) 496-4607 and request a copy, or you may download a copy of the document yourself via the Office of the Federal Register's website. If you or your office has a subscription to the Federal Register, you may simply consult the appropriate issue.

Do I need any special type of billing code for my document?

Yes, all NIH documents must include an NIH billing code which is inserted at the top left hand corner of each document.

Where do I get the billing code for a document that I want to have published in the Federal Register?

You must contact Jerry Moore, the NIH Federal Register Liaison, at (301) 496-4607.

How many copies of a document must I prepare?

You must prepare 1 signed original, 2 "certified" originals (or duplicate copies of the signed original with the additional phrase "Certified To Be A True Copy" inserted below the signature line on the last page of the document), and 1 file box copy. Also, for documents to be signed by Dr. Kirschstein and Dr. Zerhouni, 5 additional file copies must be included.

Will the Office of the Federal Register accept documents with single spacing?

No. All documents must be double spaced.

Will the Office of the Federal Register accept a document signed by an official acting for another official?

Yes. However, when an official signs for another person, the signature line must be revised to reflect the title of the person who is actually signing the document.

Can I email my document to OMA/DMS for processing?

Yes. You may email your document as an attachment to the NIH Federal Liaison, Jerry Moore, for advance review and comment. However, you must provide hard copy when submitting your document for actual publication.

When I submit a document to the OMA/DMS for publication in the Federal Register, should I supply an electronic copy of the notice on a computer disk/diskette or CD?

Yes. In order to comply with the new policy implemented by the Office of the Federal Register (OFR) on January 1, 2008, with respect to the submission of documents with accompanying copies in electronic form on diskettes or CDs, and to ensure the most economical and prompt publication of your notice, you should supply an electronic copy of your notice on a standard computer disk/diskette or CD along with the signed original and 2 signed "certified copies" (paper copy) when submitting a document to OMA/DMS for publication in the Federal Register. Please note the electronic copies should not be in signed pdf.file form, but rather in unsigned and non-pdf form (e.g., Word). The OFR will not accept signed pdf.files.

If I see an error in the document published in the Federal Register, can I get it corrected?

Yes. You should contact the NIH Federal Register Liaison, Jerry Moore, at (301) 496-4607, and inform him of the error. He will contact the Office of the Federal Register. If the error was a printing error, rather than an error in the original document, they will publish a correction notice.

Do I need to do anything special to my document if I am supplying an electronic disk copy along with the hard copy?

Yes. You must add a special suffix to the NIH billing code indicating what software was used to prepare the document. For example, a hypen and the letter "P" must be added to the end of the NIH billing code for all documents prepared in WordPerfect or Microsoft Word.

How do I obtain a copy of a FR notice published in a previous year?

You could check the on-line NIH Library which maintains several years of back issues, or you could research FR notices published in years 1994 to the present on-line via the various search options provided on the Federal Register webpage of the GPO Access website.

For notices published in years prior to 1994, you have 2 options: (1) you could physically visit the library at the Office of the Federal Register, located at: 800 North Capitol Street, NW, 7th Floor, Suite 700, Washington, DC 20001 (call the "Finding Aids Dept." of the Office of the Federal Register atl 202-741-6000 for more details); or (2) you could physically visit one of the many Federal Depository Libraties located in various states (including Maryland) and the District of Columbia.
