The Committee on Energy and Commerce met in open markup session and took the following actions:

H.R. 1108, the "Family Smoking Prevention and Tobacco Control Act", as amended by the Subcommittee on Health, was ordered favorably reported, amended, by a yea-nay vote: 38-12.
 
The following amendments were offered:

An amendment offered by Mr. Pallone, # 1, manager’s amendment, was adopted by a voice vote.

An amendment offered by Mr. Buyer, # 2, was adopted by a voice vote.

An amendment offered by Mr. Buyer, # 3, was withdrawn by unanimous consent without prejudice to be offered at a later point.

An amendment offered by Mr. Rogers, # 4, was defeated by a yea-nay vote: 20 - 28.

An amendment offered by Mr. Stearns, # 5, was defeated by a yea-nay vote: 18 - 27.

An amendment offered by Mr. Burgess, # 6, was defeated by a yea-nay vote: 8 - 35.

An amendment offered by Mr. Ferguson, # 7, was defeated by a yea-nay vote: 12 - 31.

An amendment offered by Mr. Buyer, # 8, was defeated by a voice vote.

Four amendments offered en bloc by Mr. Buyer, # 9, were defeated by a voice vote.

An amendment offered by Mr. Fossella, # 10, was adopted by a voice vote.

An amendment offered by Mr. Buyer, # 11, was adopted by a voice vote.
