Summary of Roll Call Votes at Jan. 22, 2009 Markup of Stimulus Bill

WASHINGTON – On Thursday, January 22, at 10 a.m. the committee held a business meeting to consider portions of the economic recovery package that are in the jurisdiction of the committee. Three separate measures were considered: health, energy and broadband. The roll call votes, along with summaries of the amendments, are posted here.

Summary of Title IV (Health IT) Roll Call Votes:

An amendment offered by Rep. Ed Whitfield (R-KY) would allow physicians to avoid a 21 percent cut in payment for the Medicare patients they serve. Physicians simply will not be able to afford to keep Medicare patients with such massive cuts to reimbursements and thus leave those on Medicare without access to physicians. Roll call vote: 31 Democrats  voted No; 15 Republicans voted Yes.

An amendment offered by Rep. Michael Burgess (R-TX) would replace the physician payment cuts in Medicare for 2010 and 2011 so physicians can continue to serve Medicare patients. This is the same amendment that was offered by Rep. John Dingell during the Committee on Energy and Commerce markup for the Deficit Reduction Act in 2005. The amendment offered by Rep. Mike Rogers (R-MI) would strike a provision that gives authority to politically appointed state attorneys general the ability to bring civil actions in court for violations of the federal HIPAA Privacy Rules. Furthermore, this provision makes the federal privacy law subject to local politics.  There can be strong political pressures that influence litigation at the state level.  The lack of restriction on the reach of attorneys general combined with the fact that they are elected officials, political by nature, means this provision will result in politically-motivated lawsuits. Summary of Title III (COBRA and MEDICAID) Roll Call Votes:

An amendment offered by Rep. Joe Barton (R-TX) would prevent individuals who have an annual income of more than $100,000 and assets over $1 million dollars from receiving a subsidy for COBRA premium assistance. An amendment offered by Rep. Nathan Deal (R-GA)  would set an income test for individuals to buy into Medicaid. The amendment would prevent anyone who has an income above $1 million to qualify for the Medicaid program that is paid for with tax-payer dollars. Summary of Title V (MEDICAID) Roll Call Votes:

An amendment offered by Rep. Joe Pitts (R-PA) would require the parent of a minor to be notified when a family planning clinic presumptively enrolls their child. Notification to the parents of minors would be in the best interest of the child to ensure they aren’t using a product that could negatively react with any pre-existing condition or allergies. An amendment offered by Rep. Nathan Deal (R-GA) would prohibit any state from collecting Section 5001 funds unless the state can demonstrate that no legal immigrants are receiving Medicaid coverage within the required five-year waiting period.  A fundamental component of our immigration policy in this country is the requirement that new immigrants must wait five years before enrolling on a Federally funded welfare program.  This amendment would ensure that states can’t use taxpayer dollars for free health care for immigrants who haven’t abided by the existing waiting period. Summary of Energy Title Roll Call Votes

An amendment offered by Rep. Fred Upton (R-MI) would make zero-emission energy systems available for federal loan guarantees. This would allow nuclear power, a major source of readily-available energy which emits zero carbon dioxide, to qualify for loan guarantees alongside various other renewable energy projects such as wind and solar. An amendment offered by Rep. Joe Barton (R-TX) would remove from the bill the mandate requiring states with rate-setting authorities to institute a “decoupling” policy in order to receive certain federal grants. Decoupling, already present in a few states such as California, is a policy in which states set electricity rates in a way that ensures regulated utilities recover their costs no matter what their actual sales. This supposedly allows utilities to promote energy efficiency without fear of losing revenue. However, if a customer invests in energy-efficient technologies, he would not benefit under the Democratic “decoupling” provision because the rate would be set annually. The Barton amendment attempted to remove this language in order to protect energy consumers from paying more for less energy. Roll call vote: 33 Democrats voted No; 20 Republicans voted Yes.

Carbon capture and storage technology – whether in the form of sequestering carbon dioxide from coal plants or agricultural practices to store CO2 –  hold great potential for America’s energy future and allow the continued use of coal, one of America’s largest energy resources.
