Regulation & Background

There have been three regulations issued by CMS for the PACE program. The first regulation was published November 24, 1999, as an interim final rule with comment period, establishing requirements for PACE under the Medicare and Medicaid programs. The first file under the "Downloads" section is this regulation.

The second regulation incorporated revisions to the original regulation, implementing section 903 of the Medicare, Medicaid, and SCHIP Benefits Improvement and Protection Act of 2000 (Pub. L. 106–554) by establishing a process through which PACE organizations may request waiver of certain regulatory requirements.  This regulation was published on October 1, 2002, with an effective date of October 31, 2002.

This second regulation is also an interim file rule with comment period, and was published to provide for greater flexibility in adapting the PACE service delivery model to the needs of the particular organization. Additionally, the October 1, 2002 rule removed the requirement that PACE organizations directly employ the interdisciplinary team, the program director, and medical director. Instead the PACE organization may contract with these staff members. The second file under the "Downloads" section is this regulation.

 

The third regulation is the final PACE rule, published December 8, 2006, and effective 30 days thereafter. The third file under the "Downloads" section is this regulation.
