My comments are based on the inevitably subjective evaluation of whether the primary purpose of the email is commercial. Most email I subsribe to and which I send includes commercial aspects, but is primarily based on providing significant value for free. My intention when sending email is to establish trust and credibility and any possible commercial aspects rely on that trust and credibility. (see my snail mail, attached.)
