For any act to be effective, the responsibility for adhererance to the requirements of the act must lie with the beneficiary of the message. If an advertiser wishes to use the "send to a friend" technique to reach additional potential customers, the advertisers should have to arrange for those messages to be routed thru a site they control to screen the messages for persons who do not wish to receive such material. Spoofing is a major problem which should be eliminated. Then it would be reasonable to put a limit on the number of unsolicited messages an individual could transmit in a 24 hour period. Additionally, some method to restrict the transmission or of detecting messages originating outside the USA will need to be considered or we will just push SPAMMING offshore.
