04/21/09 New page changes to the Section 8 Renewal Guide dated April 17, 2009, feature changes to Section 7, 16, Appendix 15-2, and Attachments 1 and 7.
  Reminder: EIV Coordinator's contracts and/or property (ies) must be recertified annually for continued access. All EIV Users must be recertified by April 29, 2009. All Users who have not been recertified by April 30 will be automatically expired and will no longer have access to EIV.

  Section 8 Renewal Policy guide book revision. This primarily clarifies language in Chapter 4 regarding Section 8 renewals where owners have selected Option 2, Renewals at or Below Market Rents. In addition to several small changes and clarifications, the revision also details a provision for increased owner distributions as a preservation incentive for current limited distribution owners. Please read through the guidance and make sure to incorporate the new changes to the Section 8 Renewal Guide.

03/27/09 EIV mandatory for multifamily owners and management agents effective September 30, 2009
A delay in the effective date of the Refinement of Income and Rent Determination Requirements Final Rule was published in the Federal Register today, March 27, 2009. The rule, originally scheduled to be effective on March 30, 2009, will be effective on September 30, 2009.

One of the provisions in the Final Rule published in the Federal Register on January 27, 2009, is making use of the Enterprise Income Verification (EIV) system mandatory. While all other provisions of the Final Rule were to be effective on March 30, 2009, multifamily owners and management agents were to be provided an additional six months, to September 30, 2009, to implement use of the EIV system. The Department has determined that a further delay in the mandatory use of EIV beyond September 30, 2009, by multifamily owners and management agents is not necessary. Therefore, the use of EIV will also become mandatory for multifamily owners and management agents effective September 30, 2009.

REMINDER: Deadline Approaching Owners/ Agents must insure TRACS is upgraded to avoid an interruption in monthly voucher payments. The TRACS database is moving to Version 2.0.2.C.
Release dates:

  • iMAX Implementation must be complete between December 1, 2008 and no later than February 20, 2009 if you are reporting to a CA and February 28, 2009 if you are reporting directly to HUD.
  • Implementation of TRACS 2.0.2.C must be complete no later than March 31, 2009. Between December 1, 2008 and March 31
    2009, TRACS will accept both 2.0.2 B and 2.0. .2.C files
  • Extension for Submission of Financial Statements for Projects with a Fiscal Year Ending on 12/31/2008

REVISED: Due to HUD infrastructure performance problems, MF property owners have experienced difficulties submitting their financial statements due March 30, 2009 (for owners with a fiscal year end = 12/31). The Office of Multifamily Housing Programs, Office of Asset Management has authorized REAC to implement a blanket 30 day extension for owners whose project fiscal year ends 12/31/2008 only. Owners/auditors should not request an extension in FASS; the extension has been automatically implemented. The extended FASS due date is 04/30/2009. Owners who submit the financial statements on or before 4/30/2009 will NOT be referred to the Departmental Enforcement Center or be flagged in the Active Partners Performance System. Please contact the Real Estate Assessment Center (REAC) Technical Assistance Center (TAC) on 1-888-245-4860 or via email for assistance or further guidance.

News from REAC - No filing extension
There will be no filing extension for properties with 12/31/08 fiscal year end date.
  The Financial Assessment Subsystem (FASSUB) was temporarily down between the morning of March 11, 2009, and the afternoon of March 13, 2009. During that time Multifamily Housing owners were unable to file Annual Financial Statements. The Department has received requests to extend the April 1st AFS filing due date for property owners with a 12/31 fiscal year end date. Based on the short period of time the system was unavailable, an extension of the time period to file financial reports will not be provided.
03/16/09 The following changes in Special Claims processing and Section 236 Excess Income reporting are effective Monday, March 16, 2009: Special Claims for HUD-ADMINISTERED PROPERTIES: What's a "HUD-administered property"? A property that works directly with HUD (not through a Contract Administrator, such as Contract Management Services in Washington, or Oregon Housing & Community Services) in the administration of its subsidy contract. An example of a HUD-administered property would be a Section 202 or 811 property with a Project Rental Assistance Contract (PRAC). Effective March 16, 2009, Special Claims for HUD-administered properties will be submitted directly to the assigned HUD Project Manager. Even though every property has a HUD Project Manager, this only applies toHUD-administered properties (see above). For more information on Special Claims, see HUD's Special Claims Processing Guide and Chapter 9-14 of HUD Handbook 4350.3

Section 236 Excess Income Reports have updated points-of-contact, although the submission address remains the same.

Please check now! Submission of Annual Financial Statements

For those owners with a 12/31 fiscal year-end, the time to submit your annual audited financial statements is quickly approaching - March 31, 2009.

We strongly encourage you to ensure your user and coordinator passwords, and user system access capabilities, are up-to-date. This also includes ensuring that required UII (Unique Independent Public Accountants) and passwords are also updated. Make February, the month to ensure any issues concerning password resets are addressed.

Please verify your e-mail address in FASSUB, under User ID Maintenance. This will ensure that the owner/owner-designated coordinator receives correspondence timely.

If you encounter any problems, contact: Technical Assistance Center (TAC): 1 (888) 245-4860. Users can also e-mail their questions to REAC_TAC@hud.gov. Please ensure when sending an e-mail that they indicate what their problem is in the subject line. Also include the project name and FHA number or contract number.

A list of appliances and/or major components that will be replaced along with a notation of whether or not the replacement items will be energy efficient products.  If replacement items are not energy efficient products, the owner/agent must provide a justification.

01/09/09 Disaster Reminder: Flood Insurance required in special flood hazard areas. The recent flooding in Washington and Oregon is a sharp reminder that the requirement for flood insurance for properties located in a special flood hazard area is not only a standard requirement for insured projects per the Regulatory Agreement, but also in most Housing Assistance Payments (HAP) Contracts: "Flood Insurance. If the project is in a special flood hazard area, the Owner agrees that the project will be covered, curing its anticipated economic or useful life, by flood insurance in an amount equal to its development or project cost (less estimated land cost) or to the maximum limit of coverage made available with respect to the particular type of property under the National Flood Insurance Act of 1968, whichever is less."

01/08/09 Enterprise Income Verification (EIV) System training class from December 16-17, 2008 now available on archived webcast Materials and agenda HUD staff deliver an informative slide presentation ranging from gaining and continuing EIV access, reading income information and verification reports, resolving tenant income discrepancies (including case studies) to monitoring O/A activities, as the Department moves toward eventually mandating the use of EIV for multifamily housing programs.

01/07/09 Reminder of Upcoming change of requirements The proposed revision to the regulations requires disclosure of Social Security numbers by all individuals applying for or participating in HUD's rental assistance programs. Once the Final Rule is in effect, applicants will be required to disclose and provide verification of the Social Security number for all members of their household before they can be admitted. Current residents will be required to disclose and provide verification of Social Security numbers for all members of their household, where disclosure and verification has not occurred, at the time of their next interim or annual recertification. Owners and management agents are encouraged to begin informing applicants and residents who have not disclosed their Social Security number, or the Social Security number of a child under the age of 6, or who have certified they do not have a Social Security number, of this upcoming revision to the regulations and their need to begin the process of obtaining a Social Security number.
01/02/09 The General Section of HUD's FY2009 NOFA (Notice of Funding Availability) has been published. In 2009, HUD plans to publish its NOFAs as they are approved for publication and not in a combined SuperNOFA. The anticipated schedule for release for the Section 202 Supportive Housing for the Elderly and Section 811 Supportive Housing for Persons with Disabilities NOFAs, subject to availability of appropriations, is currently projected for February through April 2009. Newest information Applicants are urged to sign up for Grants.gov's information subscription service. New users to Grants.gov will be required to complete a five-step registration process, which can take 2 to 4 weeks. If there is a discrepancy in the information, the registration cannot be completed until issues are resolved. Applicants that have previously completed the registration process have to renew or update their registration in the Central Contractor Registration (CCR). The renewal/update process confirms that the registration information is still accurate and allows organizations to make any appropriate changes. Please allow adequate time to resolve any registration issues.
