3-2 - AUTHORITIES

Section 314 of the Bioterrorism Act (see RPM Chapter 2) amended the Federal Food, Drug, and Cosmetic Act by inserting language into Section 702(a) to authorize FDA to commission other Federal officials to conduct investigations under the Federal Food, Drug, and Cosmetic Act.  As a result of the change, FDA may commission other Federal officials pursuant to a memorandum of understanding between the Secretary and the head of the other Federal department or agency.
