Procedural Preferences for DIG Acquisitions

Order of preference for DIG procurements equal to or less than the Emerging Small Business (ESB) reserve amount:

(1) ESB set-aside,
(2) Combined 8(a)-HUBZone set-aside
(3) 8(a) set-aside or competitive HUBZone set-aside
(4) competitive SDVOSB set-aside
(5) SDVOSB sole source
(6) small business set-aside, 
(7) unrestricted competition. 
Order of preference for DIG procurements over the ESB reserve amount:

(1) Combined 8(a)-HUBZone set-aside
(2) 8(a) set-aside or competitive HUBZone set-aside
(3) competitive SDVOSB set-aside
(4) SDVOSB sole source or (if over $100K) HUBZone sole source
(5) unrestricted competition. 

Small business set-asides may not be used except for A-E services, non-nuclear ship repair and selected construction codes, as indicated below.

Notes:

1 - Comptroller General, in protest decision B-400278, B-400308, 9/19/2008, has taken exception to language of the SBA regulations that gave equal preference to HUBZone and SDVOSB set-asides.  In making this ruling the GAO looked beyond the regulations to the language of the authorizing statutes. While 8(a) and SDVOSB set-asides are made at the CO's discretion, the HUBZone set-aside is mandatory.

2 - The term "unrestricted competition" refers to competitive procedures of FAR Parts 12, 13, 14, 15 or 36, as would otherwise apply to the commodity and dollar value of the procurement.

3 - ESB reserve amounts are defined in FAR 19.1002.
