SUBJECT: Delegation of Authority to the Director, United States Secret Service, to Issue Administrative Subpoenas Pursuant to the Presidential Threat Protection Act of 2000

1. DELEGATION. By virtue of the authority vested in the Secretary of the Treasury and the authority delegated to the Under Secretary (Enforcement) by Treasury Order (TO) 101-05, there is hereby delegated to the Director, United States Secret Service, the authority of the Secretary of the Treasury under section 5 of the Presidential Threat Protection Act of 2000, P.L. No.106-544, §5, 114 Stat. 271 (2000), and under 18 U.S.C. § 3486 to issue in writing and to cause to be served an administrative subpoena in an investigation of an imminent threat constituting an offense under 18 U..S.C. § 871 or 879 or an imminent threat against a person protected by the Secret Service under 18 U.S.C. § 3056 (5) or (6). Such an administrative subpoena may compel: i) the production of any records or other things relevant to the investigation; and ii) testimony by the custodian of the things required to be produced concerning the production and authenticity of those things.

2. REDELEGATION. The authority assigned by this Directive may be redelegated in writing, in whole or in part, to the Assistant Director, Office of Protective Research, who may in turn redelegate in writing, in whole or in part, to the Senior Intelligence Officer/Special Agent in Charge, Intelligence Division.
