TREASURY DIRECTIVE: 76-01

SUBJECT:  Department of the Treasury Acquisition Regulation and Department of the Treasury Acquisition Procedures

 

1.   PURPOSE.  This directive authorizes the Department of the Treasury Acquisition Regulation (DTAR) and the Department of the Treasury Acquisition Procedures (DTAP).

2.   SCOPE.  The DTAR and DTAP are binding on all bureaus, offices and organizations in the Department of the Treasury except the United States Mint (pursuant to the authority in 31 USC 5136), including the Office of the Inspector General (OIG) and the Treasury Inspector General for Tax Administration (TIGTA).  The authority of the Inspectors General is set forth in Section 3 of the Inspector General Act and the Internal Revenue Service Restructuring and Reform Act, and defined in Treasury Order 114-01 (OIG) and Treasury Order 115-01 (TIGTA), or successor orders.  The provisions of this directive shall not be construed to interfere with that authority.

3.  POLICY.  In accordance with Treasury Directive (TD) 12-11, "Procurement Authority," the Senior Procurement Executive is responsible for prescribing and publishing Department-wide procurement policies, regulations, and procedures.  Accordingly, the DTAR and DTAP provide uniform policies and general procedures to be used by bureaus when contracting for supplies and services.

 a.  The DTAR contains any supplementary regulation that requires codification in the Code of Federal Regulations (CFR).  The DTAR supplements the Federal Acquisition Regulation (FAR), providing guidance when the FAR is not sufficiently detailed, or when details are left to Departmental discretion.

b.   The DTAP contains internal policies and procedures that do not require public comment or codification.

c.   Any reference to TD 76-01 shall be deemed to include this directive, the DTAR, and the DTAP.

5.   COPIES OF REGULATION AND PROCEDURES.  The DTAR, the DTAP, and their amendments may be obtained from the Office of the Procurement Executive.

7.   CANCELLATION.  Treasury Directive 76-01, "Treasury Acquisition/Procurement Regulation," dated January 8, 1990, is superseded.
