UNION RIGHTS . . . DEMONSTRATION PROJECTS

Department of Defense, U.S. Army Medical Materiel Agency, Fort Detrick, Maryland and Local 2484, American Federation of Government Employees, AFL-CIO, Case Nos. 00 FSIP 38 and 00 FSIP 45, June 7, 2000 (Release No. 432).

The UNION proposed that the 77 employees it represents be allowed to opt out of the Laboratory Personnel Management Demonstration Project, which was implemented before it was certified as the exclusive representative of the bargaining unit.

The AGENCY proposed a democratic solution, i.e., that all bargaining unit employees vote, "with no abstentions permitted, on whether to continue participation in the demo project, with a simple majority determining the outcome."

The PANEL ordered that the dispute be resolved on the basis of the UNION's proposal.
