The AGENCY proposed that employees use accrued annual leave, compensatory time, advanced annual leave, leave without pay (LWOP), or earned time off awards for two days the base was closed for the Air Force's 50th anniversary celebration.

The UNION proposed the following:

The Air Force [shall] recredit all leave taken by bargaining-unit employees on 25 and 26 [of] April 1997, or [] establish compensatory time for leave taken, or [] change leave taken for time off awards.

The PANEL ordered the adoption of a compromise proposal requiring the AGENCY to grant administrative leave to unit employees who would have worked on the days the base was closed.

Department of the Army, Headquarters 10th Mountain Division and Fort Drum, Fort Drum, New York and Local 400, American Federation of Government Employees, AFL-CIO, Case No. 97 FSIP 94, January 2, 1998 (Release No. 405).

The AGENCY proposed the following:

Section 10

In the event of a death of an immediate family member, and if an employee has no annual leave to his/her credit, the Employer will normally approve a request for three days of either leave without pay or advanced annual leave, if otherwise allowable. Sick leave may also be granted to make arrangements for the funeral of an immediate family member in accordance with the Family Friendly Leave Act and implementing regulations.

The UNION proposed the following:

B. On military training holidays, civilians may be considered for equivalent time off awards.

Section 10

In the event of a death in the immediate family (parents(s), sister(s), brother(s), spouse, child/step child, and grandparents), any Employee covered by this agreement will normally be granted administrative leave of up to three (3) days. If additional leave is needed and the Employee has no annual leave to his credit, the Employer will normally advance to a permanent Employee sufficient annual leave to cover the above periods. Employees may use sick leave in the place of annual leave if incapacitated for work mentally or physically.

The PANEL ordered the adoption of the AGENCY's final offer.

Social Security Administration, Boston Region, Boston, Massachusetts and Local 1164, American Federation of Government Employees, AFL-CIO, Case No. 98 FSIP 35, May 12, 1998 (Release No. 409).

The AGENCY proposed the following:

The MOU concerns management's decision to cease the practice of Christmas shopping time in the field offices shown on the attachment.

The practice will cease on a phased out basis with the 42 offices listed on the attachment, ceasing the practice effective 12/31/98.

Management agrees to follow the provisions of Article 31 of the National Agreement in approving/disapproving excused absences.

The UNION proposed the following:

Employees in the 42 SSA field offices in the Boston Region listed in Attachment 1 will be granted excused absence, in the indicated number of hours between Thanksgiving and December 31, 1998. Local office management will follow existing procedures for granting Christmas Shopping Time in their offices.

With respect to continuing the practice of granting Shopping Time in the listed offices, the parties agree to abide by any decision to terminate or modify the practice reached during anticipated 1999 national contract negotiations. If the national negotiations do not terminate or modify the practice, it will continue.

The PANEL ordered the parties to adopt the AGENCY's proposal.

National Aeronautics and Space Administration, NASA Exchange-Johnson Space Center, Houston, Texas and Local 251, Hotel Employees and Restaurant Employees International Union, AFL-CIO, Case No. 98 FSIP 65, June 30, 1998 (Release No. 410).

The AGENCY proposed to replace annual leave and sick leave benefits with personal leave benefits. Employees would be eligible for personal leave after a 90-day probationary period. On an annual basis, full-time employees would earn 40 hours of personal leave with less than 1 year of service, 80 hours with 1 to 5 years of service, 120 hours with 5 to 1 years of service, and 160 hours with more than 10 years of service. Part-time employees would earn half as many hours for the same years of service. There would be no limit on the number of accrued hours unit employees could carry over from year to year.

The UNION proposed that both full-time and part-time unit employees would be eligible for annual and sick leave after 90 days on the job. With regard to annual leave, on a yearly basis, full-time employees would earn 104 hours with 3 or less years of service, 160 hours with 4 to 15 years of service, and 208 hours with more than 15 years of service. Part-time employees would earn half as many hours for the same years of service. All employees could carry over 240 hours of accrued annual from year to year.

The PANEL ordered the parties to maintain the status quo (Arts. VIII and IX in the current CBA).

FT employees with 1 to 2 years of service earn 40 hours of AL each year, while those with 3 or more years of service earn 80 hours; PT employees earn half as much leave for the same years of service. Employees can carry over up to 240 hours from year to year. With regard to SL, FT employees earn 80 hours annually regardless of their years of service, while those working PT earn 40 hours annually. There is no limitation on the accumulation of SL, although it is "not payable in the event of resignation or discharge." Terms and conditions for use of AL and SL are also specified.
