EIS Adoption Review Schedule and Possible Outcomes

As directed by the Nuclear Waste Policy Act of 1982 (NWPA), the U.S. Nuclear Regulatory Commission (NRC) must conduct an adoption review of the environmental impact statement (EIS) that the U.S. Department of Energy (DOE) submitted with its license application for the proposed geologic repository at Yucca Mountain. This adoption review may have one of three possible outcomes:

  1. Adopt the EIS without further supplementation.
  2. Do not adopt the EIS.
  3. Adopt the EIS in part, but determine that the EIS requires a supplement.

The position of the NRC staff, as to whether or not to adopt DOE’s EIS, will be announced along with the NRC’s docketing decision in a Federal Register notice (see NRC’s Acceptance Review).  This Federal Register notice will be published approximately 90 days after receipt of the EIS and license application. 

The NRC will also prepare and publish an Adoption Determination Report (ADR), which will be referenced in the Federal Register notice.  That report will document the staff’s review of the EIS and any supplements provided to the NRC, as well as any information independently identified by the NRC staff.  The ADR would support the NRC staff’s determination as to whether it is practicable to adopt the EIS provided by DOE.
