ADM EXECUTIVES RESENTENCED TO SERVE ADDITIONAL JAIL TIME WASHINGTON, D.C. - In Chicago today, Judge Blanche M. Manning resentenced former Archer Daniels Midland executives, Michael D. Andreas and Terrance S. Wilson for their roles in a conspiracy to fix prices and allocate sales in the lysine market worldwide.
Andreas was resentenced to serve 36 months jail time and Wilson was resentenced to serve 33 months jail time. The judge made no change in either of the former executives' fine amount.
The resentencing was mandated by an earlier Seventh Circuit Court of Appeals' ruling that the District Court had erred in denying a sentencing enhancement for their leadership roles in the conspiracy. Andreas, former Executive Vice President, and Wilson, former Group Vice President and President of ADM's Corn Processing Division, were previously sentenced to serve 24 months jail time and to pay fines of $350,000 each.
Joel I. Klein, Assistant Attorney General in charge of the Department's Antitrust Division made the following statement:
"The increased sentences imposed in this case should strengthen the message that executives who engage in price fixing will pay a heavy price - significant jail time."
