- License Application |

The Nuclear
Regulatory Commission (NRC) will
conduct a detailed technical review
of the License Application. The NRC will:
- Evaluate the extent to which it can adopt the Department of Energy’s Final Environmental Impact Statement (EIS). The EIS explains the potential environmental and economic impacts of building and operating the Yucca Mountain repository. For more information, please see the NRC's Criteria for Adoption of DOE's EIS.
- Prepare a Safety Evaluation Report. The report will provide
- a thorough discussion of the information provided by DOE in the application,
- the scope of NRC staff’s review,
- its analysis of this information, and
- its findings and conclusions.
The NRC's Atomic Safety and Licensing Board Panel will hold public hearings during which it will consider the scientific and design information on the repository. After completion of the proceeding, the ASLBP will forward its initial decision to the NRC commissioners for their review.
The NRC will grant a construction authorization only if it concludes from its investigations that the radioactive material described in the application can be received and disposed of without unreasonable risk to the health and safety of the public.
If construction authorization is granted, DOE will begin construction of the initial phase of the repository.
Before receipt of a license to receive and possess waste, the license application will be amended for NRC review in accordance with the requirements of 10 CFR 63.24: Final NRC Rule for Disposal of High-Level Radioactive Wastes in a Proposed Geologic Repository at Yucca Mountain (10 CFR 63). If significant new circumstances or information relevant to environmental concerns are identified, DOE will also supplement its environmental impact statement in accordance with 10 CFR 63.24 requirements.
