Sec. 567.100 Antipasto, Common or Usual Name (CPG 7116.01)
BACKGROUND:
A commodity known as "antipasto" is more or less well known to those of
Italian extraction as an appetizer consisting of mixed vegetables and fish products.
Policy stating that the term "antipasto"
was accepted as the common or usual name of the product appeared in TC-32, February 9,
1940.
POLICY:
For purposes of section 403(i)(1) of the Federal Food, Drug, and Cosmetic Act, and section 4(a)(1) of the Fair Packaging and Labeling Act, the term "antipasto" is accepted as the common or usual name for an appetizer consisting of mixed vegetables and fish products.
The label of the food must bear a prominent and conspicuous statement in which the ingredients are listed by their specific common or usual names in descending order of predominance in accord with section 403(i)(2) of the Federal Food, Drug, and Cosmetic Act, and *21 CFR 101.4 and 101.15.*
