INFORMATION REPORT SECY-08-0165 October 31, 2008
Contact: Office of Nuclear Reactor Regulation (NRR) Onsite Environmental Audit of Kewaunee Power Station (KPS) During the week of October 20, 2008, the staff performed the first part of its onsite environmental audit at KPS, in support of the staff’s review of the license renewal application. The review focused on environmental issues pertaining to the preparation of a Supplemental Environmental Impact Statement required under Title 10 of the Code of Federal Regulations Part 51 to support the staff’s evaluation of the license renewal application. The second portion of the audit is scheduled to be conducted during the week of January 12, 2009. License Renewal Public Meetings for KPS On October 22, 2008, the staff conducted two identical Category 3 public meetings in Kewaunee County, Wisconsin, to inform the public about the license renewal process for the KPS license renewal application, and to gather public comments regarding the environmental scoping pertaining to the Kewaunee Environmental Impact Statement preparation. In attendance were members of the public, representatives of Dominion Energy Kewaunee (the applicant), local citizens, and local news media. Public comments were taken concerning environmental topics, emergency planning, security, continued plant operation, and spent fuel storage. Office of Nuclear Material Safety and Safeguards (NMSS) Biweekly Status Telephone Call with the U.S. Department of Energy (DOE) On October 16, 2008, representatives of the NRC staff and DOE began conducting biweekly telephone calls to discuss issues related to the license application for a geologic repository at Yucca Mountain. The biweekly meeting focused on the status of requests for additional information, future meetings, and correspondence. The meeting was conducted via teleconference with access available for the public to listen. Office of Federal and State Materials and Environmental Management Programs (FSME) NRC Collaborates with the Bureau of Land Management (BLM) on Uranium Recovery Issues On October 21, 2008, NRC staff met with BLM Headquarters (HQs) staff to continue discussions on cooperation on uranium recovery license applications and environmental reviews. The staff had previously met with BLM Field Offices in Wyoming to initiate cooperation and solicit their ideas on approaches for formalizing cooperation. BLM HQs suggested that a Memorandum of Understanding (MOU) be signed between BLM HQs and NRC. BLM will provide an outline of the MOU to NRC. Given the pending change in Administration, in the interim, issues will be handled on a case-by-case basis. Low-Level Waste (LLW) Teleconference On October 23, 2008, the staff participated via teleconference in a meeting of the Northwest Interstate Compact on Low-Level Radioactive Waste Management held in Portland, Oregon. The Compact regulates the import and export of LLW from the Compact, especially into the U.S. Ecology Hanford Washington disposal facility. At the request of the Compact, staff gave a presentation on blending of LLW and staff’s consideration of potential changes to existing guidance. Fingerprinting Requirements On October 25, 2008, the fingerprinting requirements for the New York City Department of Health and Mental Hygiene’s Office of Radiological Health became effective. The New York City Board of Health gave final approval of various amendments, which included the fingerprinting requirements, to Article 175 (Radiation Control) of the New York City Health Code on September 17, 2008, and they were published in the City Record on September 25, 2008. The New York State Department of Health has indicated that they will implement the fingerprinting requirements during the week of November 17, 2008. These actions will complete issuance of the requirements for all the Agreement States. Office of Nuclear Regulatory Research (RES) Publication of Draft Regulatory Guide 1205 (DG-1205) “Bypassed and Inoperable Status Indication for Nuclear Power Plant Safety Systems” On October 22, 2008, NRC staff issued the subject draft regulatory guide to provide an opportunity for public comments. The draft guide is proposed Revision 1 to Regulatory Guide 1.47. This guide describes methods the staff considers acceptable for use in complying with NRC’s regulations governing bypassed and inoperable status indication for nuclear power plant safety systems. Publication of Regulatory Guide (RG) 1.114, Revision 3, “Guidance to Operators at the Controls and to Senior Operators in the Control Room of a Nuclear Power Unit” On October 23, 2008, NRC staff published the subject RG. The RG describes methods that the staff considers acceptable for use in complying with Commission regulations that require the presence of an operator at the controls of a nuclear power unit and the presence of a senior operator in the control room from which the nuclear power unit is being operated. Office of Nuclear Security and Incident Response (NSIR) Public Meeting with Wisconsin Emergency Managers and Local Law Enforcement Agencies On October 22, 2008, NRC staff attended a meeting with Wisconsin Emergency Managers and local law enforcement agencies in Madison, Wisconsin. The group discussed NRC’s requirements for in-transit security of spent fuel and safeguards information management and handling. The information will help the State better understand the security regulations and prepare for the shipment of spent fuel from the University of Wisconsin to Savannah River, which will occur during the 2009-2010 timeframe. International Support On October 23, 2008, NRC staff presented a Refresher Course on “Consequence Management of Malevolent Use of Radioactive Material—Strategies for Enhancing Security of Radioactive Materials,” at the 12th International Congress of the International Radiation Protection Association (IRPA-12) Conference in Buenos Aires, Argentina. This presentation is publically available through the Agencywide Documents Access and Management System (ADAMS) at ML082890020. Office of Administration (ADM) Thomas E. Magette on Behalf of EnergySolutions, LLC; Notice of Denial of Petition for Rulemaking (PRM-50-88) On October 20, 2008, the NRC published a notice (73 FR 62220) denying a petition for rulemaking submitted by Mr. Thomas E. Magette on behalf of Energy Solutions, LLC. The petitioner had requested that the NRC’s regulations governing domestic licensing of production and utilization facilities be amended to provide a regulatory framework that would allow funds from licensees’ decommissioning trust funds to be used for the cost of disposal of “major radioactive components” (MRCs) that have been removed from reactors before the permanent cessation of operations. The NRC concluded that the arguments made by the petitioner and the commenters were not sufficiently persuasive to support the proposed rulemaking. The NRC’s policy on not using decommissioning trust funds for the early disposal of MRCs during operations is prudent and necessary generically to preserve and protect such funds. Other sources of funds can be used to dispose of MRCs during operations, and in extraordinary circumstances licensees may request an exemption under 10 CFR 50.12 to permit withdrawal of decommissioning trust funds to dispose of MRCs; the NRC will review such requests on a case-by-case basis. Office of Information Services (OIS) 2008 Federal Information Technology (IT) Summit On October 22, 2008, staff from the Information and Services Division and the Business Process Improvement and Applications Division attended the 2008 Federal IT Summit, which was sponsored by the Federal Chief Information Officer (CIO) Council. The summit focused on three major tracks: Information Technology Workforce (development and bridging the multiple generations), Management (integration of acquisition, project, and performance for effective management of programs) and Technology (Web 2.0 and cyber security requirements). Region II (RII) Site Tour of the Proposed Site of Calvert Cliffs Unit 3 On October 21, 2008, the Regional Administrator, the Deputy Regional Administrator for Construction, and the Director, Office of New Reactors met with Unistar management and toured the proposed site of Calvert Cliffs Unit 3 in Lusby, Maryland. Region IV (RIV) Meeting with Wolf Creek Nuclear Operating Corporation On October 21, 2008, the staff met with management representatives of Wolf Creek Nuclear Operating Corporation in the Region IV office to discuss performance at the Wolf Creek Generating Station and the status of the station’s performance improvement plan. The public meeting was held at the request of the licensee. Wolf Creek Nuclear Operating Corporation presented updates on initiatives implemented to improve the station’s performance in the areas of Problem Identification and Resolution and Human Performance. |
