Receipt of US-APWR Design Certification Application

On December 31, 2007, Mitsubishi Heavy Industries tendered via hand-delivery an electronic Design Control Document for Design Certification of the US-APWR Standard Nuclear Power Plant Design under Part 52. The submittal contains the final safety analysis report, environmental report, technical reports, and referenced reports. The NRC staff commenced an acceptance review of the application on January 2.

Publication of Final Regulatory Guides 1.84, 1.147, and 1.193

On January 2, Regulatory Guides 1.84, 1.147 and 1.193 were issued. Revision 34 of Regulatory Guide 1.84, "Design, Fabrication, and Materials Code Case Acceptability, American Society of Mechanical Engineers (ASME) Section III," lists all Section III Code Cases that the NRC has approved for use. Revision 15 of Regulatory Guide 1.147, "Inservice Inspection Code Case Acceptability, ASME Section XI, Division I," lists all Section XI Code Cases that the NRC has approved for use. Revision 2 of Regulatory Guide 1.193, "ASME Code Cases Not Approved for Use," lists the code cases that the NRC determined unacceptable for use on a generic basis. Agreement with the Autoridad Regulatoria Nuclear of Argentina (ARN)

On January 3, the Executive Director for Operations signed an Implementing Agreement with ARN for participation in the NRC Cooperative Severe Accident Research Program. This research will expand the NRC’s and the international community's data and knowledge base in the area of severe accident research and expand insights on severe accident computer code development, assessment, and applications. The work performed and technical information exchanged under this Implementing Agreement enhances the quality of NRC's reactor safety codes. The NRC uses these codes to evaluate potential risk and security scenarios for severe accidents, address regulatory and licensing issues for operating plants, and to review new designs. The signed Implementing Agreement will be sent to Argentina for countersignature. This Implementing Agreement will become effective upon signature and will remain in effect for a period of five years.

Lincoln County, Nevada; Denial of Petition for Rulemaking (PRM-2-13)

On December 28, 2007 (72 FR 73676), the NRC published a document in the Federal Register that denies a petition for rulemaking submitted by Lincoln County, Nevada (PRM-2-13). The petitioner requested an amendment to the regulations that would allow it and other affected units of local government to be represented in NRC proceedings concerning the proposed high-level waste repository at Yucca Mountain by any duly authorized individual, including a non-attorney consultant. The Commission denied the petition as unnecessary because current regulations allow Lincoln County the representation it seeks.

List of Approved Spent Fuel Storage Casks: HI-STORM100 (Amdt. 5) (AI24 - Part 72)

On December 31, 2007 (72 FR 74162), the NRC published a direct final rule in the Federal Register that amends the HI-STORM 100 cask system in the list of approved spent fuel storage casks (Amendment 5) (AI24 - Part 72). This amendment includes a number of specific changes to the certificate of compliance for this cask system. The direct final rule becomes effective March 17, 2008.

On December 31, 2007 (72 FR 674209), the NRC published the companion proposed rule to this direct final rule in the Federal Register. The comment period closes January 30, 2008.

List of Approved Spent Fuel Storage Casks: HI-STORM100 (Amdt. 4) (AI23 - Part 72)

On January 2, 2008 (73 FR 17), the NRC published a notice in the Federal Register that confirmed the effective date of January 8, 2008, for the direct final rule that was published in the Federal Register on October 25, 2007 (72 FR 60543). This direct final rule amended the NRC's regulations to revise the HI-STORM 100 cask system listing to include Amendment No. 4 to Certificate of Compliance (CoC) No. 1014.

Expiration of Safety Light Corporation (SLC) Licenses

On December 31, 2007, NRC licenses issued to SLC authorizing activities at their facility in Bloomsburg, Pennsylvania expired. The Environmental Protection Agency (EPA) has responsibility for the site under their Comprehensive Environmental Response, Compensation and Liability Act regulations. In the near term, SLC representatives will continue to work on site to remediate contaminated equipment and facilities. Security, fire protection, utilities and maintenance of the facilities are being provided by SLC in accordance with an EPA Administrative Order. RI will continue to monitor activities at the site because the licenses continue in force for remediation activities pursuant to 10 CFR30.36(c).
